In an attemipt to avoid an Ontario- Municipal Board hear- ing into aspects of the Kaitlin Development at the Port of Newcastle, Municipal Solicitor, Mr. Hefferon, certain senior municipal staff memnbers and Kaitlin representaives met ear- lier this year to seek solutions to a difficult situation, These negotiations resulted in a proposed 'Principles of Under-standing' between the Kaitlin Group and the Municipality. Under these Principles, Mill St. would remain the primary access to the development. This would necessitate thie reconstruction of the Mill St. CNR underpass at the cost of $4.5 million. PreviGus discussions at the draft plan approval stage, had Toronto St. as the main entrance to, this development. Upgrades to Toronto Street would include the construction of a new bridge and access ramrps at Toronto Street and the CN Rail tracks. These upgrades were estimated to cost $6.2 million. When counicil approved Phase 2 of the Port of Newcastle Developmiet, they required from Kaitlin, a security deposit of 100% of these works. This, according to Kaitini was unfair, thuts their desire to go to the Ontario Municipal Board.
