In defense of the proposed by-law, Mayor Adrian Foster said he believed Durham Regional Police would "exercise good judgment in what they do." The Nuisance By-Law was preceded by a Loitering ByLaw passed by the Municipality in 1994 also at the request of the Durham Regional Police. The Loitering By-Law was intended to assist the police in dealing with groups of people congregating and causing problems for pedestrians in certain areas in the Municipality. In her report to council recommending the proposed Nuisance By-Law be adopted, Municipal Clerk Patti Barrie stated, "Acts of general rowdiness and unacceptable conduct have increased and the police have once again come to the Municipality for assistance. " Police will now have the option to charge individuals creating a nuisance under Clarington's new Nuisance By-Law or by laying criminal charges, "if, in the opinion of the investigating officer, such action is warranted," according to Barrie's report. landowner is expected to plant and maintain the trees they receive through the program. The municipality asks that the trees be planted outside the road allowance so as not to impact potential future road works. Most of the old trees that line our rural roads were planted by farmers in the midand late-19th Century who took native maples from their woodlots to plant along the edges of their property and along their laneways. These trees are now succumbing to old age, wind exposure, insects and disease and are not being replaced. Through the Environment Stewardship fund, the municipality is attempting to preserve this part of our cultural landscape from becoming further degraded. While the municipality pays for the trees, and the Conservation Authority provides the trees, the rural Mysie Vanhinsberg of Port Hope recently donated her late son's collection of over 100 mounted local birds to the Ganaraska Forest Centre, for which she was officially thanked on Monday afternoon.
