DurhamCLEAR was set to appeal the security cost ruling and a July 17th court date was set for a "Leave to Appeal" hearing. In a press release issued on Friday, DurhamCLEAR President Doug Anderson claims that while the group was fairly confident they could win the appeal, "The legal process was dragging on so slowly that the incinerator was likely to be built before we ever got a decision on the main motion." The group was also concerned whether a judge would turn back a $300 million project which was sub- stantially completed. Finances were the other factor weighing on DurhamCLEAR's decision to end their legal battle against the Region's incinerator. The group which had a membership list of 33 last November was unable to raise enough funds to cover their outstanding legal bills. The organization say they will continue to push towards zero waste and will continue to point out the "Fatal weakness in the Region's plan to build the incinerator," according their treasurer Paul Kuebler, "But continuing the legal action would have been financially draining with dubious prospects," they state in their press release.
