INSUtANCl Mr. Ken Hooper, 143 Ontario Street, Bowmanville, Ontario. L1C 2R6. Dear Mr. Hooper: RE: O.M.E.R.S. Inquiry On behalf of the Town, my apologies for not responding to your inquiry prior to this date, but the Council and Administration Administration of the Town wished to conduct a full inquiry into the matter. A review covering the period from January 1st, 1980 to December 31st, 1984, was •undertaken. From the information information gathered, it appears that during this time period there were eight (8) occasions where in error, refunds were processed from O.M.E.R.S. that do not conform to the O.M.E.R.S. Regulations. I would hasten to add, that our auditors and O.M.E.R.S. have advised, that the refunds only involved the employees' contributions contributions to the fund together with interest on the employees' employees' portion. None of the Corporation's contribution to O.M.E.R.S. were paid out to the employees. I wish to inform you, that O.M.E.R.S. have indicated that when the employer makes a contribution to the By Isabelle Challice fund, it is vested in that fund forever, whether or not an employee is terminated. The only circumstances where an employer is entitled to a refund is if the money was wrongfully collected in the first instance. O.M.E.R.S. takes the view that while unlikely unlikely the municipality may be exposed to some liability, should employees receiving an improper payment later request the years' of service reinstated for pension purposes. purposes. In this connection, the four employees still employed by the Corporation who, in error, received payment, will be requested to repay their contributions received 'with interest as calculated by O.M.E.R.S. In addition, certain administrative administrative changes are being made to safeguard against any repetition of similar errors. Yours truly, DavidS. Johnston, M.C.I.P., Chief Administrative Officer.
