This new piece of legislation is preventative in form and suggests: 1. Ways to regulate the bargaining process. 2. Measures to avoid bargaining bargaining impasses. 3. Alternatives to confrontation: confrontation: 4. Provisions for collective bargaining. EDUCATION RELATIONS COMMISSION The most effective suggestion suggestion in the Bill is the establishment of the Education Education Relations Commission; an independent advisory body of 5 impartial people. This Commission will be responsible responsible for monitoring and assisting all local negotiations between teachers and school boards. The Commission will act on behalf of teachers and school boards. "Tie Commission Commission will act on behalf of teachers and school trustees as well as parents and students to ensure that all bargaining is carried out in good faith.. GUIDELINES Guidelines for negotiations are also laid out in this new Bill and the major points included in negotiation conduct conduct are: a) Negotiations are to be carried out at a local level; either party may obtain outside assistance. b) A 7 month period must be allowed for any negotiations. c) All agreements begin September 1 and end August 31 and may be for 1 or more years. , d) Negôtiations will cover any term or condition of employment with a few exceptions, exceptions, i.e. pensions, e) Every agreement will provide a grievance clause for -negotiation during the life of the contract. f) At any time in negotiation either party may ask for an Education Relations Commission Commission factfinder or refer the issues to voluntary, binding arbitration or to Final Offer Selection. Final Offer Selection is a form of voluntary, binding arbitration which requires a secret ballot vote on the last offer of the school board and is considered an innovative move on the part of the government of Ontario. The creation of a factfinder is also a new preventative move in teacher-school board negotiations who will be assigned by the Education Relations Commission to step in when negotiations are at a standstill. The factfinder will investigate both ' sides and submit a written report. PREVENTATIVE FEATURES, I know most of you are concerned about the right-to- strike section of the Bill and I hope that I can best explain it by again emphasizing the preventative nature of the Bill. The conditions are: 1. No strike, lock-out, etc. is allowed during the life of an agreement. 2. No strike action is allowed until after a factfinder examines examines the situation and has his report made public ; this is followed by a 30 day 'cooling off' period. 3. Commission. ) PERSONAL VIEW There are a " number of reasons why I hesitate to give this new Bill my hearty support. I believe that strike action greatly, lowers the dignity of the profession and that actions of that sort should not be endorsed nor encouraged. encouraged. Another consideration is the loss of valuable school time for the students who .become pawns in arbitration disputes to say nothing- of the ill-wind created between parents and teachers. Another thing to bear in mind is that unlike industrial issues, there is no limiting factor in teacher disputes. Unions must consider the consequences of plant shutdowns shutdowns and, as a result, labour disputes are well thought out and not open-ended affairs. This would not be the case with the teachers as there are no limiting factors. While I have some reservations reservations about the effectiveness of this new Bill, I intend to follow the legislation with interest and hope that practical practical use finds it an effective method of dealing with teacher-school teacher-school board arbitration.
