TAKE NOTICE that the Council of the Corporation of the Town of Newcastle intends to: apply to the Ontario Municipal Board pursuant to the provisions of Section 35 of the Planning act for approval of By-law 76-21 passed by the Town of Newcastle on the 19th day of April, 1976. Any person may within fourteen (14) days after the date of this Notice,send by registered mail or deliver to the Clerk of the Town of Newcastle notice of his objection to approval of the said by-law together with a statement of the grounds of such objection. Any person Wishing to support the application for approval of the by-law may vyithin fourteen ( 14) days after the date of this notice send by registered mail or deliver to the Clerk of the Town of Newcastle notice of his support of approval of the said by-law together* with a request for notice of any hearing that may be held giving the name and address to which such notice shall be given. WHEREAS the Council of the Town of Newcastle deems it advisable to amend Zoning By-law Number 1653 of the former Township of Clarke; NOW THEREFORE, the Council of the Town of Newcastle ENACTS as follows: ' ' - "t 1. Section 3 of By-law 1653 is hereby amended by 'deleting the present sub-section 3.15 and substituting therefore the following revised subsection. "3.15 LOTS HAVING LESS AREA AND Oft FRONTAGE . Where a lot having a lesser lot area and-or lot frontage then that required herein is held under distinct and separate ownership ownership from abutting lots at the date of passing of this Bydaw as shown by a registered conveyance in the records of the Registry or Land"Titles Office, or where such a lot is created as a result of a consent granted by the Clarke Committee of Adjustment before December 31, 1973, or where such a lot is. created as the result of an expropriation, such smaller lot may be used and a building or structure may be erected, altered, or used on such a smaller ' lot, provided that a II other requirements of this By-law are complied with." 2. The Region is being asked to issue debentures in the amount of $147,477.00 at a rate of interest of .88 per cent. Mcllroy, A.M.C.T. 1 Clerk Town of Newcastle Dr. Bette Stephenson, Minister Minister of Labour, said today that only arenas that have' been certified as safe by a professional engineer will be allowed to open next fall. In December 1975 the Minister Minister addressed a letter to the heads of councils of all local municipalities asking them to procure a report from a professional engineer on the arena's safety. Dr. Stephenson commended those municipal councils who filed reports and compiled with the directions issued by the Industrial Safety inspectors. inspectors. She asked that those who had not complied do so immediately to protect the lives of the children and the adults in the community. Forty percent of the province's province's 869 arenas are suspected of not being capable of safely sustaining local snow and wind loads as required by the 1970 National Building Code of Canada. Of these 350 "Suspect" arenas, 200 have been inspected inspected in the past six months and 57 ordered closed. Some of these (57) arenas have been demolished, replaced or repaired repaired in the meantime. The remaining 150 will be inspected inspected and appropriate action, taken by the end of July. In a few cases where engineer's reports state that the building is capable ■ of withstanding certain wind and dead loads, arenas have been allowed to remain open until October 15th to accommodate accommodate summer activities. However, the Minister warned, warned, "We are certainly trying to be charitable but it's difficult to be excessively charitable when human safety safety is involved". Municipalities have reçeiv- ed five letters concerning arenas in the past, five years.; October 1970 - a recommendation recommendation to obtain a professional engineer's report on arena safety; November, 1971 - a similar letter; August 1972 - a letter requesting confirma- 1 tion of arena information in Ministry's files ; November, 1974 - copies of previous three letters togethe'r with a questionnaire questionnaire to be completed and returned; December, 1975 - letter from Dr. Stephenson. A Newcastle OPP spokesman spokesman said Christopher Edward Edward Mudge, 28, of Toronto, died in the 8:40 p.m. collision. Mr. Mudge was a passenger in a late model sports car being driven on the track by Ian L. Johnson, 35, also of Toronto, said police. The spokesman said the sports car was northbound when it was involved in a collisjon with a southbound station wagon. Passengers of the second ear were treated for minor bruises and cuts at Bowman- ville Hospital and released. Harvey Hudes, Mosport executive vice-president, said today, this accident was the first of its type that he is aware of. . At the time of the collision track officials were attempting attempting to clear the speedway but few of the spectators were heeding the flagman, he said. He said barriers were up, to prevent access to the track at the time.
