The ins and outs of rent increases Rent increases « Only selected parts of The Residential Tenancies Act are in effect at the present, time, primarily those dealing with rent increases. The particular rules which apply to rent increases increases are known as Rent Review. Under the Rent Review provisions provisions of The Residential Tenancies Tenancies Act, there are limits on the amount and frequency of rent increases which landlords landlords can charge. A method of reviewing rent increases proposed proposed by landlords is also established. established. Before learning these rules, it's important to know what is meant by the word "rent." ; Basically, The Residential Tenancies Act defines rent as any amount of money paid by the tenant to the landlord, for , any services, privileges, facilities facilities or accommodation. This includes not only the basic accommodation charge, hut also any separate charges which might be collected for "extras" such as cable televi- ' sion or parking. 1 , Therefore, an increase in any of the fees charged by the landlord to the tenant is considered considered a rent increase, and governed by the rules of Rent Review. It's also considered a rent increase to charge extra or separately for something that previously was included- ill the rent. , The first, rule about rent increases is that there can be only one rent increase per year, regardless of amount. And that's not just v>n the tenant, but on the rental unit itself. For example, if the rent for an apartment was increased September 1,1980, there can; be no further rent increase of any 1 amount for this unit until September 1,1981 -- even if., a different tenant moves iti following the Initial rent in-, crease, or a different landlord takes over the property following following the rent increase. When a rent increase can be charged without violating the above rule, a landlord is limited limited to a rent increase that doesn't exceed six per cent of the current rent, unless the landlord has received approval from the Residential Tenancy Commission for . a higher increase. Since increases in rent usually usually originate with the landlord, here are the steps which the .landlord must follow: First of all, the landlord must give the tenant 90 days notice in writing for any proposed proposed rent increase, regardless of amount. The written notice should spell out the present rent, and the monthly increase which is proposed, expressed Orono Weekly Times, Wednesday, November 12th, 1980-H both in dollars per month and as a percentage of the current rent,.. There is a particular form, called a "Notice of Rent Increase," Increase," which landlords must use for notifying the tenant. Copies are available from many legal stationery firms, or from the Commission. Rent Review If the proposed increase is more than six per cent above the current rent, the landlord must apply to the Commission to justify the higher increase. This is known as applying for Rent Review. A special application form is used for this purpose, and must be filed with the Commission no later than 60 days prior to the ( effec- ■ live date of the proposed increase. increase. A copy of the application application must also be provided to the tenant, The Residential Tenancy Commission offices can be contacted for any information regarding the rights and obli* gâtions of landlords and tenants. tenants.
