Finlay Agricultural Representative NEW FAMILY LAW ACT The Family Law Act, Bill Number One has been passed and replaces the Family Law Reform Act of 1978. ■ Previously assets were referred to as family assets and other assets. The family home, boat, cottage were considered family assets and the farm property was another asset. The family assets were div- died equally and other assets were split according to the contribution made by each spouse. The new law has the concept of net family property property and divdies the net value of all assets owned by both spouses. Exceptions Exceptions include an inheritance or property brought into the marriage. The increased value of these assets during the marriage is considered family property. A Marriage Contract is a type of partnership agreement that can provide provide a different distribution of assets if the marriage breaks down; Marriage children prepare a marriage marriage contract to assure the continuation continuation of the farm business if the marriage fails. The contract can provide the formula for dividing the children's family property without the surprises that can come out of a lawsuit. , The new Act also provides for the splitting of assets of spouses when death occurs.
