Screen & Ballet" at St. Paul's United Church in resolves charges The Region of Durham today completed a resolution of the outstanding charges that had been laid against it, in 2002, under the Ontario Water Resources Act. Durham Region pleaded guilty to six charges and agreed to pay a fine of $40,000, plus a victim fine surcharge payable to the Province of Ontario. The charges relate to events that occurred following the implementation of Regulation 459/00 under the Ontario Water Resources Act. There are three categories of charges to which Durham Region has pleaded guilty. The first category relates to failing to notify the Ministry of the Environment in a timely fashion of indicators of adverse water quality on a number of occasions in the Fall of 2000 and in 2001. Citing a Statement of Facts, which was read into Court, Durham's lawyer Leonard Griffiths stated that these events occurred due to a difference difference of opinion in the interpretation interpretation of the reporting requirement requirement in Regulation 459/00. He went on to say that it was agreed that Durham Region took all appropriate steps to respond to the indicators, and that at all times the quality of water was good, and there was no evidence of any form of bacterial contamination. The Crown agreed there was no evidence of an adverse effect in the water. This error in the interpretation interpretation of the notification procedures procedures in the Regulation was identified in 2001 and Durham Region's procedures were amended. The second category of charges relate to failing to comply with a requirement in the then-existing Certificate of Approval to monitor Well #6 in the Greenbank community for nitrates on a monthly basis. Prior to Regulation 459/00 coming into effect Durham Region tested all of its wells for nitrates on a monthly basis even though that requirement was only necessary for well #6 in Greenbank. Subsequent to Regulation 459/00, Durham Region commenced sampling its wells for nitrates on a quarterly quarterly basis consistent with the requirements of the Regulation. Durham Region was not aware that the monthly monthly sampling requirement for Well #6 in Greenbank had been preserved by the Regulation. Monthly sampling for nitrates at Well #6 in Greenbank was resumed immediately upon being advised by the Ministry of the Environment in early 2001 that the requirement under the Certificate of Approval was still in existence. Mr. Griffiths noted in the Statement of Facts that there is no longer a requirement to sample for nitrates at Well #6 in Greenbank on a monthly basis in the new consolidated Certificate of Approval. Such samples are now taken on a quarterly basis. The final charge relates to exceeding the permitted rate of taking water from Well #1 in Greenbank under a Permit to Take Water. Mr. Griffiths told the Court that the Region's Permit to Take Water contains both a litres per minute rate of taking of water and a daily maximum quantity of water permitted to be taken from a well. Due to a malfunctioning flow control device, Durham Region exceeded the permitted litres per minute rate of taking water at Well #1 in Greenbank. At no time, however, did Durham Region exceed the maximum daily quantity of watér permitted to be taken within the existing Permit to Take Water. It should be noted that Durham Region's water sup ply was safe at all times and there were no adverse environmental environmental effects as a result of the events which led to the above noted charges. Durham Region is committed to continuing to cooperate with the Ministiy of the Environment, to ensure that the residents of the Region have access to the highest quality of municipal water.
