BETWEEN SAMUEL RUSSELL of the township of Cramahe in the County of Northumberland and Province of Ontario, Farmer OF THE FIRST PART
AND LULU ANNIE BEATTY of the Township of Percy in said County, Married Woman, OF THE SECOND PART
WHEREAS the said Samuel Russell by agreement for Sale of land, purchased the land and premises hereinafter described from Mary Grace Haynes late of the Township of Cramahe in the County of Northumberland and Province of Ontario, Widow, and is now deceased;
AND WHEREAS, the said party of the Second Part is the heir-at-law of the said Mary Grace Haynes;
AND WHEREAS a payment on the said place of the First Part gave a chattel mortgage to the said Mary Grace Haynes and the said part of the First Part not being able to carry out his agreement for sale has requested the said Party of the Second Part to release him therefrom and to make a sale of the chattels mentioned in the said chattel mortgage, for the purpose of paying the amount due under the said chattel mortgage and interest thereon and expenses incidental to the said sale, the balance, if any, to be paid over to the said Party of the First Part.
NOW THIS INDENTURE WITNESSETH that in consideration of the premises and the sum of ----ONE---- Dollar now paid by each of the parties thereof to the other (the receipt for which is hereby acknowledged) the said party of the First part hereby agrees to allow the said party of the Second Part to make a sale of the chattel property mentioned in the before-mentioned chattel mortgage to ratify the amount of the said chattel mortgage with interest thereon and any amount over and above the amount of the chattel mortgage with interest thereon and after deducting the expenses of the said sale shall be paid over to the said party of the First Part.
The said party of the First Part is also to release the said party of the Second part from the Agreement for Sale of the said lands and hereby agrees to give up possession of the said lands as soon as the said sale is over.
The said Party of the Second Part hereby releases the said party of the First part from the Articles of Agreement dated the sixteenth day of April 1930, the said release to take effect after the sale of the above chattels.
The land mentioned in the said Articles of Agreement being as follows:-
ALL AND SINGULAR that certain parcel or tract of land and premises situate, lying and being in the Township of Cramahe, in the County of Northumberland and Province of Ontario and being composed of the east half of Lot number thirty-three (33) in the Tenth Concession of the said Township of Cramahe, [?] and except thereout and there from the north ten (10) acres and four (4) acres out of the south-east corner and the south part of the west half of Lot number Thirty-three (33), Concession Ten (10) in the said Township of Cramahe containing twenty-nine (29) acres and being all that part of the said west half lying south of that part heretofore conveyed by one Thomas Harrison Tuck to Frederick John Tuck and the south part of Lot number Thirty-four (34) In the Tenth Concession of the said Township of Cramahe containing by a measurement fifty-eight (58) acres of land be the same more or less and particularly described in the deed thereof from Thomas Harrison Tuck to Diggory Salter and George Haynes, dated the first day of March 1892, and registered in Book-- for the Township of Cramahe as number 5340.
