If you buy out of town, and I buy cut of town, and all the neighbours buy out of town, what in thunder will become of our town. Lid you ever think about it? | EXPRKSS ADS. BRIXG RESULTS Action was entered in the Supreme Court of Ontario Monday by John W. Alrd, on behalf of himself and all other members of the Presbyterian Church at Grafton, against William H. Johnston, J. C. Hutchinson and John Underwood. Grafton, seeking recovery of the church and manse prop-eray at that village, long known as St. Andrew's Presbyterian Church. It Is expected that the action will come •before Hon. Mr. Justice Rose for hearing at the Spring Assizes of the Supreme Court, which opens at Cobourg or. April 16. The case is being watched with extreme interest throughout the Dominion, as it may have an important bearing phases of the Church Union Act. iA-t the recent session of the Ontario Legislature, application was made by 'Mr. Aird and the congregation he represents to the Private Bills Committee for legislation covering the unusual situation which has arisen in connection with the church property. In view of the fact that the matter is already before the courts, the Private Bills Committee did not report to the Eregislature on the application. The statements of claim and. defense, filed Monday, are very extensive and cover more than a dozen foolscap pages. The plaintiff, in his statement of claim, points out that the church property and manse property were conveved to the trustees of St. Andrew's Presbyterian Church by John Grover, Esq.. and Hon. George Strange Boulton. It is claimed that In conformity with the provisions of the trust deed, the congregation worships under the Westminister Confession of Faith. REX vs. SEGUIRE First Divisional Court. Jan. 30, 1928 ■ Appeal by the defendant from his conviction, after trial in the County Court Judge's Criminal Court for the County of Northumberland, upon a charge of conspiracy to defraud. Palmateer does not state what the transac- deal. The two men differ as to what occurred in Montreal. The accused says that with money of his own and $3,000 supplied by Palmateer they together purchased 24 cartons, each ces of morphine, which they bag and took to the station in Montreal and there deposited it in check bex. the key being given to e accused. This occurred he says about 10 o'colck in the morning, ten they proceeded to put in the peal. The accused says that he' put which he placed and that in the ndcriugs p round . with the key. when they got to •e unable to get Mil the thei . the box i mber of bo the bag 1 nlaced. hut it could not be found. Imateer's story is different. He that in the morning he handed noney to the accused for the pur-of the contemplated deal. Palma-remaining at the hotel and the accused departing to complete the that later the accused returned he hotel ?"d stated that he had been robbed of the money. Palmateer denies the purchase of the morphine and his contention is that in Montreal ":e accused stole his money. James W. Seguire. when lending the money, knew that it was to be used by Palmateer in connection with p. deal which he and the accused con-emplated entering into, but, so far as it appears he knew nothing of its iture. and there is no evidence to irrant a finding that he conspired ith the accused to defraud Palmateer, and, therefore, it follows that the ■cused was not guilty of consp:racv. Conviction quashed. The above is taken from the Ontario-Weekly Notes, a publication which reports all important cases heard before the Appeal Court at Osgoode Hall.
