Oct. 30, 1974 The Colborne Citizen Page 5 Sales tax collectors want pay Claiming that "the Retailer is the unpaid tax collector for the Province of Ontario", the Retail Merchants Association of Canada (Ontario) Inc., has, again, presented a petition to the Ontario Government "For compensation to be paid to Vendors registered under the said act (Retail Sales Tax Act) for the collection of the tax imposed by the said act". According to the brief, the Association first presented a brief to the Honourable Allan Grossman in July 1973, and also presented the Brief to the Honourable John White. The Brief now being presented is addressed to the Honourable Nomination day November 12th. Nomination Day for municipal and other board offices for the upcoming elections Dec. 2, has been set as November 12 with a nomination period running from Thursday, Nov. 7 to 5 p.m. Nov. 12. Prior to the enactment of The Municipal Elections Act, 1972, the practice in Ontario was to hold a nomination meeting, usually in the evening of nomination day, at which candidates for municipal and other board offices were nominated. Under legislation existing at that time no provision was made for the filing of a nomination paper at any other time. With the enactment of the new statute in 1972, and first commencing with elections held in that year, the procedure was changed to provide for a nomination period during which a person may be nominated as a candidate for an office by filing in the office of the municipal clerk responsible for the nominations, a nomination paper in the prescribed form. This is the procedure now in effect. A booklet compiled by Michael J. Smither titled "Candidates And Electors", which is available at most municipal offices for a nominal charge, sets forth, in Chapter 1, a Candidates Check List. It lists the steps to be taken by each candidate from the time he decides to seek office until after he is elected. Here is that list: 1. Determine the office for which you wish . be n lated. 2. Check to establish that you hold the statutory qualifications required for such 3. Check to ensure that you are not disqualified from holding such ai Remember that the "...onus is person nominated for election to i to file a bona fide nomination paper." 4. Check to ensure that the office that you are seeking is not incompatible with an existing office that you hold. 5. Ascertain which municipal clerk or other person is responsible for conducting the nominations for the office to which you aspire. 6. Obtain a copy of the' prescribed combined form for Nomination, Consent to Nomination and Declaration of Qualification from the person responsible for conducting the nominations. 7. Observe and comply with the pertinent deadlines applicable to the filing of nomination papers. 8. Determine the qualifications required for electors who are eligible to nominate you for election to the chosen office. 9. Obtain the requisite number of signatures (ten) of such qualified electors upon the nomination form. 10. File the combined form referred to the office of the person 3r conducting the under step 6, responsible nominations. 11. Obtain tcopies of the preliminary polling list and statement of changes from the municipal clerk. Consult the municipal clerk or clerks responsible for nominations and polling to make yourself familiar with any special arrangements and facilities provided. 14. Plan your campaign. Observe the restrictions on advertising. Consult your municipal clerk as to any restrictions on the erection of signs, posters and other advertising devices which are applicable in your municipality. 15. Note all important dates including • those for advance poll and regular polling day. 16. Make yourself familiar with the basic principles pertaining to Conflict of Interest which will apply if you are elected. 17. Polling day - Do not forget to vote. 18. If successfully elected to the office of member of council, trustee of a police village or public utilities commissioner, before entering on the duties of your office, make and subscribe a declaration of office and oath of allegiance. Such declaration to be filed in the office of the clerk within eight days after it is made.~ Such a declaration must be taken on or before the day fixed for holding the first meeting of the body to which you are elected and in default you will be deemed to have resigned. Under such cirmcunistances the seat would become vacant. 19. If successfully elected to the office as a member of a shcool board or as a school trustee, on or before the day fixed for the first meeting of the new board make and subscribe a declaration of office before the secretary of the board or any person authorized to administer an oath. The brief claims Ontario is the only province where the retailer does not get paid for collecting sales taxes. A table, published in the brief, shows retailers in Saskatchewan keeping all the tax collected on the first $3,800and one percent on all sales tax collected over that amount. At the other end of the scale, the table shows retailers in Nova Scotia as receiving 112 percent of the 7 percent tax collected. In summary of the brief, it is claimed that "All retailers registered as vendors under The Retail Sales Tax Act are now unpaid tax collectors for the Province of Ontario". Contained in a covering letter to Ontario retailers which is signed by the Association's Secretary-Manager, C.B. Gorrell, is the statement "The Independent Retailer always the backbone of this country has been the forgotten person in Government thinking for too long. The loss of this compensation and the long delay on regulated store hours are only two examples to remind us of this fact. With a new Minister of Revenue perhaps, - just perhaps, we are not forgotten".
