City Solicitor McIntyre was asked this morning what line of action he would advise the council to follow, in view of the decision of the court of appeal. His reply was : "HI the matter is not carried further hy the company, I will advise the city to act at once, and take over plant at the original award of the arbitra tors. If, however, the company ap peals further, and keeps the city out of possession of the works for any considerable length of time, 1 will, on behalf of the city, apply to the courts for a reference back to the arbitrators to write off a certain amount for de preciation "The depreciation of such a plant was the subject of a great difference of opinion during the recent arbitra- tion, and various estimates were giv- en by experts on both sides. No doubt, on such a reference back, a substantial sum would be written off the original award. To such an allow- ance for depreciation the city is justly entitled, "Under the assessment act, they city assessor for this year has assessed the company's plant at $170,000, the am- ount of the award. This has been done because it has been defined that the assessable value of such a plant is the aleable value. Upon the company's appeal to Judge Wilkison last month, the judge confirmed the company's as sessment at that figure, subject to the right of the company to reduce the amount by showing evidence of depre sation. Councillor Pringle seconded the reso lution. No other nominations wére made, and Mr. Cox was, therefore, elected by acclamation. He was escort ed to the chair hy Councillors Spoor and Pringle. The newly elected warden thanked the council for the honor it had conferred upon him, and stated that he would do his best to till the position with honor to himsel! wnil to the county. It was moved by Councillors Pringle and Gray that Councillors Gram, Tap ping, Wilkins, Franklin, Pillar and Cox be a committer to elect the standing committees for the year. Joshua Cox, Olden, Has a Muni- cipal History. Joshua Cox, the newly-elected warden of Frontenac, has a municipal history of over a Yuarter of 4 century. He was born in the province of Que bee, and has lived in Olden township for the past forty-four years, being a well-to-do farmer.
