The only evidence 1 offered on behalf of the ap- plication was a very strong declara- tion from Alderman'J. H. Bell, claim ing that the construction of a subway was absolutely necessary, the traffic record procured by Cambridge under Alderman McLeod's orders and at the city's expense, the plans made by the city engineer, and that of the city en- gineer himself, who was our only oral witness and who attended before the committee at the expense of the city, in order to explain' hie plans and his the cost. Let us t from the records the course the citv council took. On February 17th, 1902, I find by the minutes that a communication was read from JW, Edward, county clerk, asking the appointment of & committee to act in conjunction with the county council in reference to the railway crossing ut the G.I:R. lower _ station. This request was 8 sorted by Warden Spoor and Councillors Toner ~ and Fair, and, on motion of Alderman Mcbood it was resolved "that the fol: lowing be a deputation to go to o- tawa to assist the deputation from the. county council in an endeavor to get the committee on railways of the flouse of Commons to make some move towards the construction, of a subway at the outer station of G'T.R., namely the mayor, Aldermen Farrell and Meleod."" So Alderman Mcleod was determined to himself be in at the death. . This was to be no request: to the 'railway company to do the work, but a deputation to wait on the railway committee at Ottawa to formally support an ap plication directing the building of a subway with all that that might in volve. That it would almost certain: ly lead to the city being saddled with some -of the cost of the work would, one would think, be apparent to any- one making the slightest pretension to intelligence. The city 'solicitor saw it at once and sounded a note of warning in a letter to the mayor, read, 1 believe, to the finance com- mittee, but withheld from council. Those simple gentlemen from the country, essrs. Spoor, Pringle, Toner and Fair, the representatives of the county council,~on which body these astute city representatives have already waited to point out the un- wisdom of its course, and on which they expect to again wait with the same object--saw clearly that the vity would have to' bear its share of the expense. But, in response to an other warning from the city solicitor, the city council, on November 10th, 1902, after the formal notice of ap plication had been given, passed the following resolution: "Moved by Al derman Walkem, seconded by Alder man Bell, that this council desires to co-operate with the county eouncil of Frontenac in the consgruction of the subway referred to in the communica tion (of the city solicitor) just read, and that with this 'object in view they hereby suthorize the finance committee to provide for any expense which may be incurred in the prepa ration by the city engineer of the preliminary plans, and also the ex pense of "any deputation 'from this council to attend before ' the railway conmmittee of the privy council at Ot- tawa to further the object." Surely, without any warning from the eitv solicitor, ex rienced aldermen, such os Messrs. McLeod and Bell, lawyers euch ax Messrs. Walkem and King, wight have seen what was so appar ent to Mr. Melntyre, the county re- presentatives and everyone else who gave the matter any attention. These gentlemen went into this mat ter either with the most blundering stupidity, which is impossible to be lieve, or wilfully, and now are anxi ous to éscape from the consequences of their action. The desire to place th- responsibility on me would be rather clever were not the facts all against them. T was not a member of the city council when any of the fateful steps were taken. My connection with and conduct in the matter from first to last has begn that of solicitor con weientiously trying to discharge his duty to his clients to the best of his ability.
