Toronto, Nov. 24.--Judge Britton has rather upset the calculations of thé parties in the action of Charles W. Bonter vs. Samuel Nesbitt, two Brighton apple dealers. Nesbitt had Boater arrested in 1902, for misap- propriating £2,100, but Bonter had a counter claim for £3,215. The charge was dismissed, and Bonter brought action for damages for false arrest. When the action came on for trial be- fore Judge Britton, R. C. Clute, K. C., to explain the case for his client, the plaintiff. The defendant's counsel then rose, and put in an ar- gument for a settlement signed by Bouter and Nesbitt, by which, £15 cash was to be paid and a cheque was put in for 8355; this had been made without Ciute's knowledge, and V'on- ter had left by train for Toronto. Judge Britton decided not to hear the case, and dismissed the action. Clute asked to impound the defendant's cheque for $355 for his costs, but this the judge refused.
