He remembered Brice land on a trip over, and had been asked for money by the reeve to pay the cantain, shortly after tyine up at the wharf. T eaid: "1 haven't any money. if you want to pay the money You will have to give a cheque. Brice land told me to tell passengers there would be ng 11.30 teip." Mr. Whiting got a "yes" to th question that the trip was cancelled bosause the boat was late. The purs er did not hear the captain ask the reeve for his money. Deckhand Heppner said this was his first seavon and that he was one of two deckhands om every day, hut " Thursday, when there were usually three. He heard Capt. Several similar cases to the present one were pointed out by*Mr. Rigney wherein ing it, without a just reason, he was entitled to damages.
