At four o'clock Tuesday = afternoon the only criminal case in the docket: The King vs. Young for theft, was opened before Judge Clute, John (. oung, of the township of Oso, was charged with stealing $105 from Ira Cooke, on the 11th of September. John Melntyre, K.C., appeared for the prisoner and F, J. French, K.C., of Prescott, as crown prosecutor, The case for the erown was partly heard last wight, and resumeh this morning at nine o'clock. After some evidence was taken, his lordship asked the frown prosecutor whether the evidence of the two crown withesses, yet to be called, would strengthen the case, al ready presented. Mr. French replied in the negative and his lordship then told the jury that, in his opinion, as a matter of law, there was not suf ficient evidence to justify him in tell ing the jury that they might find the prisoner guilty. There was suspicion but that was not enough. He with drew. the case from ihe tury and di: rected a verdict of "pot guilty" t, be entered. At the same time he con sidered that the prosecutor was quite that the action of slander, brought by the prisoner against Ira Cook, ought not to be prosecuted, J.
