Mr. Lyons contended that the evi dence was not suflicient but witness said it was the most authoritative to be had. From all the points witness measured, he reached the same con. clusion, John McKelvey said that the line of the steps of his old house had, for years, been the lime of the street. Lawrence O'Brien, James Hamilton and John O'Brien, old residents of the city, testified to the original line. The city engineer repeated his form- er evidence, saying he gave Mr. Gra ham a line of the street. ' For the other' side of the case, de- fendant took the stand. He stated that he got the line of Wade's Lane from the city engineer andl found that in his purchase he had not gotten the frontage for which he had paid. He said the city engineer told him he had no line of e street, but would draw a line from the oldest house on the strest, Witness lined his house from that. Mr. O'Brien was there and said the corner of his house wast the line. Segeral residents: on the street Soul inhd that witness was en ero hing on. the street. He declared the city. engineer had told him he was not building off the line. Ho was not notified his houses were on the street, until two weeks ago. To Mr. McIntyre he declared there had been no building done since notification. Charles Barber, carpenter, declared that he was present when Mr. Craig lined out Wade's Lane. He said Mr. Craig stated it would be all right if the building was kept back five fest from the walk, Mr. Craig, called in rébuttal, said he never told Graham that he could pot define the line. He declared Gra- ham had built over the line measured out for him, F. W. Timms, foreman of streets, helped measure Clergy street line with Mr, Craig. He declared Graham was given the line. Mr. Mcintyre thought there could be kno hesitation in declaring that Gra- ham had built over the street, Mr. Lyons thought that even if it were shown that Graham was a foot or so aver the street, as the rule had been largely broken, the magistrate should take this into consideration. He considered Graham did not wilful ¥ build over the line. The magistrate interrupted, saying that Mr. Graham had acknowledged he knew the steps were on the street. He did not see why one should be al. lowed to take city property. The magistrate decided to enlarge the case for a week for reserved Judgment.
