L. Whiting was prosecuting at- torney and 1. J. Rigney appeared for 3 The prisoner pleaded "not guilty." According to 'the story of the com- inant, who is an Assyrian peddler, through the interpreter, Frank Abdu, he had selling a few things at White's house, near Clarendon Sta- tion, early in' the month of April. Af- ter he had gone down the road he was fired upon, four times, by the isoner and was frightened into giv- g Badore his money, some $25. He identified the prisoner and the rifle on exhibition as the one which Badore carried. The next witness, Duard White, Clarendon Station, tokl of the peddler. being at his brother's home one day the fore part of April. Witness mate the peddler. In the house at the time were Badore, Mrs. Badore, Mrs. A. White and witness. The peddler went out the front door and Badore slipped out the back, tak- ing a smal rifle which he had brought in with "him. Witness shortly after followed Badore as he had said he was going to scare the peddler, © He followed the footprints in the snow and saw where the two had evidently stopped, and the marks of the butt of the gun. Arthur White, brother . of the pre vious witness, was af work on a building about shalf a mile below his house when he heard four shots. Later Badore passed the house and thé pris- oner had the rifle and a doublebarrel- ed shot gun in his hands. Badore told witness he had chased the ped dler. The morning after, witness saw prisoner and he sak next time he would rob - the peddler. When Badore was tokl he would be arrested, he boasted he never would be as long. as the gun had a tri y Mes. Lena Whiter? wife of the pre- vious witness, corroborated the evi- dence of her brother-in-law. Mrs. Badore was the only witness on her husband's behalf and her evidence was contradictory to the evidence for the crown. Asked by Mr, Whiting as to her previous relations with a man named Macdonald, before her marriage to Badore she said 'I never lived with him." Mrs. Badore appeared with the baby about which she complained to the po- lice some ten days ago. She claims the child, in arms, was left her by an- other woman, with whom she became uainted on a trip to the city. r. Whiting in addressing the judge i out the information had not Qa es correctly laid out against the prisoner. Under the circumstances, in that a gun figured. he could have been given life imprisonment with flogging. As the information read the maxium penalty was fourteen years, be asked for that. Badore stood up to hear the sent- ence. He is of a heavy type, probably a halfbreed, his slanting brow pro- bably bespeaking the Indian in: him. He is a man whom one would want to "steer elear" of when angered; he has a menacing, threatening counten- ance and animal strength in his heavy thick-set frame. He is not likely over twenty-four years old. He is given a bad name throughout the-back coun- try as a lazy, dangerous mortal. He has served a previous sentence of one year. in Central Prison. In imposing the sentence of fourteen years the judge said, he could not help finding the prisoner guilty and felt he should. give maximum sentence as a protection to the public. Badore was granted a final word, and declared he was innocent, that the witnesses were all enemies of hie and had sworn falsely. As he left the chamber, he turned and kissed his wifo. -------------- A LIGHT NEEDED. Suspicious Character Loiters on King Street, Monday evening, while two young ladies, living in the west end, were returning home from a church soeial at 10:30 o'clock, they were followed and attacked by a man on the corner of King and Albert streets. London, May 29.--The startling news which Lloyd's received from Vladivostok, announcing that the Ger- man steamer Soerabaya, given up as lost and removed 'from the list of "Overdues" given out by Lloyd's, had been discovered frozen in' the pack ice at Nikolaiefsk, near the Amur river, has caused considerable interest in shipping circles. Acvording to the meagre cable the corpses of the crew were found completely frozen on board of the steamer, ; The Soerabaya, which was formerly a well-known Dutch East India steam. er, took a cargo of coal out to Japan during the Russo-Japanese war, but afterwards entered the service of the Russian government. The vessel took a cargo of arms and ammunition ip- tended for the defence of Vladivostok, but was unable to enter that post owing to the Japanese blockade. and took refuge in the Amur river. There, last October, she received orders not to proceed to Vladivostok until after the ratification of the peace treaty, and accordingly waited her time. Shortly afterwards the vessel disap- peared, and nothing is known of hr subsequent movements. I The steamer Erna was dispatched, in November last, from Vladivostok, in search of the missing ship, but re- turned, having found no trace of eith- er the steamer or its crew. Th Soerabaya, which was of 2,441 toy gross, carried a crew of some thirty hands. It is presumed'that part of the cargo, which was valued at som £250,000, can be saved. An expedition will be sent out to recover as much as possible of the cargo and the frozen bodies of the sailors. 'Cataraqui School Wins. ataraqui school has won the ba ner. At the meeting. Sydoey, May ' 29.--A sensational story of the sea is related by the offi- cers of the German steamer Willehad, which has arrived at Sydney from the islands of the Bismarck Archipelago. A few weeks ago six French eon: victs from New Caledonia were dis- covered on a remote portion of the Island of New Britain in a deplorable condition, and on being questioned it was ascertained that they, with ten others, had escaped from Noumea nearly twelve months ago. They constructed several rude rafts from staves of beer barrels, and rig- ged their frail craft with sails of the most primitive description. One of the rafts, occupied by six men, affer. many. months, safely reached an uninhabited portion of New Britain, after a terrible voya of nearly 2,000 miles. For four months the men were tramping in search of civilization, and eventually they were found and brought to Herbertshohe. PITH OF THE NEWS.
