SCHEDULE "A Articles of Agreement made this 20th day of April, ). 1907, BRETWE The Stanley Smelting Works hereinafter called the Contractors of the First Part and The Corporation of the City of Kingston, hereinafter called the Corporation of the Sec ond Part. Witnesseth., Whereas, in order to encourage the estab lishment and operation by the Contractors at the City of Kingston of a lead smelting plant, the Corporation are willing to grant to the Contractors a site as hercinafter described and exemption from taxes for the period of ten years and further to undertake as hereinafter provided, -- And whereas, the Contractors, in considera tion of the said grant and undertaking of the Corporation, are willing to establish and oper ate a lead smelter at the City of Kingston Now this Indenture witnesseth, that the said parties hereto covenant, promise and agree each with the other of them as follows: 1. The said Contractors shall build, equip; maintain and operate upon the site herein after mentioned, in the City of Kingston, a lead smelting plant as herein particularly set forth, 2. The said lead smelting plant shall be modern in design and construction and shall be equipped and furnished with modern and improved machinery and appliances capable of smelting and turning out merchantable lead. 3. The said plant, machinery and appliances shall when constructed be of the value of $40,000 at least, exclusive of the value of the site, and the Corporation by its servants and agents shall have the right at all reasonable times to go upon the said site to examine the plant, machinery and appliances of the Con tractors for the purpose of determining whe thar this term of the agreement has been ful hil 4. The Contractors shall commence the rec tion of -their said plant on said site in terms this agreement within four weeks after a finite assurance shall have been given to the rporation that the Department of Public Works or other Department of the Dominion Government will procure to be dredged during the year 1907 a channel of at least twelve feet. in depth as hereinafter mentioned and the plant shall be fully completed and operating in accordance with the minimum terms and re quirements of this agreement within twelve months after commencing the erection as afore. said: such asyurance as to dredging to bé given in writing by a responsible inister of the Crown not later than 1st June, 1907 6. The Corporation shall by all lawful means endeavor to procure the Government of the Dominion of Canada to dredge a channel of at least twelve feet in depth and of a suf- ficient width from the dock or pier to be erect: ed at and opposite the said lands to the navi gable waters of the Great Cataraqui River. 10. The Corporation shall consent to the laying down of a single track railway sidin Street and along Orchar Street to the lands hereby agreed to be con- veyed to the Contractors but subject to such terms and conditions as the Board of Railway Commissioners for Canada or other proper authority in the premises shall prescribe, but eo ation to said Board for permission to lay wn such railway siding as aforesaid shall be 'made by and at the sole cost and charge of the Contractors. 11. The Corporation shall, by its Council as soon as may be, procure to be submitted to the electors of the Municipality of the City of Kingston under the provisions of the Munici- pal Act in that behalf, a Bylaw authorizing the granting of the said lands and exemption as rm beqore provided; and in case the said By-law receives the assent of the electors, the Corporation shall, by its Council, pass the same and authorize and direct the Mayor to sign and seal the same. 12. In case the said By-law shall, on such submission, fail 10 receive the assent of the clectors, as required by the Municipal Act, then this agreement and said By-law shall be null and vod. 18. The Contracfors shall concurrently * with the execution and delivery by them of. this agreememt deposit with the execution and de- livery by them of this agreement deposit with the City Treasurer of the Corporation, the sum of $300, and the Corporation shall 'thereout reimburse themselves all expenses necessarily incurred in and about the submission of the said By-law to the electors, in case after the passage, of the same by the Couneil of the Corporation the Contractors shall fail to per- form the provisions of their part, but the said deposit shall be repaid to the Contractors upon the City Engineer cer. tifying to the Council of the Corporation that the Contractors have. expended $5,000 upon the said plant or upon the Clerk of the Corpora: tion certifying that. the said By-law has upon its submission to the electors as aforesaid fail ed to receive the assent of that proportion of all the qualified ratepayers necessary to render the said Bv-law valid, or in case the Corpora tion shall not on or before 1st June, 1907, have received a definite assurance in writing from a responsible Minister of the Crown as aforesaid that a channel shall be dredged as herein provided. 14. The Contractors shall in the month of January in each year, during the currency of the exemption of taxation herchby agreed to be given, file with the City Clerk of the Corpora: tion a statement under oath showing: (a) The number of men employed in the City of Kingston in and about the said plant during the then previous calendar year and the average number of working days during each of said men was so employe (b) The money disbursed and paid out by the Contractors in wages inthe City of Kingston to workmen employed in and about said plant during the then previous calen: dar year. 15. The Contragty shall be from compliance Fi the terms of sub-clauses (a) and (b) of Clause 5 in case the said plant shall be obliged to cease work and shut down owing to strikes, flooding of mines or a break: down of mac! ry. 16. If the Corporation shall so desire, the City Auditor shall be permitted by the Con- tractors to have access to the books of ac count of the Contractors for the purpose of verifying the correctness of the statements in the foregoing clause 14 mentioned. MacKenzie, was married to Major H. E. Burstall. The pretty bride wore white satin, embroidered in silver tissue, and a very beautiful pearl collar, with diamond clasp, ome her father's many handsome gifts. Tha bridesmaids were her two sisters, Miss Hilda and Miss Marjorie MacKengic, and Miss Constance Scott, her cou- sin. They wore extremely pretty gowns of white chiffon, with hyacinth blue hats and pelerines. The best man was Mr. Thompson, from York- shire, a cousin of the groom. After the ceremony there was a large re coption at the Royal Alexandra ho tel, at which there were ome hu and sixty guests. Mrs. Burstall's go- ing-away gown was a very becoming one of blue, with hat to match, and an ermine stole. Mise Laycock, who last vear visited Mrs. John Mackie, at St. Andrew's manse, and has of late been out west with her brother, is now in town with Mrs. Fife Fowler, Brock street. TERRIBLY MUTILATED. Explodes Dynamite Injuring i Seven Men. Quebec, May 1A terrible explos ion in a lumber shanty, in the upper part of Montmagny took place a few days ago. The shanty is situated be- tween the townships of Moose and Ar mand, and was occupied bv a party of men, who were breaking an ice jam in the river for which purpose thoy were emploving -dynamos. The dynamite cartridges were being dried on the stove in the shanty, in which there were at the time seven men, all of whom were about the stove. One man came along with a pot, which he, unthinkingly, placed on the stove with a sudden jar, and immediately there was a terrific explosion, which knocked down the men. all of whom whom were badly mutilated; five so horribly that they are in a critical condition. The names of the men are : Emile Robin, Ar{ Robin, Cleophas Colin. G. Morin, Simeon. Pickard, Jr. Emile Robin was the most terribly jured. of the party. His hand and forearms were mutilated and burned, and his eyes were also painfully burn- ed. His companions received grave injuries about the head and hands. The injured men 'were taken to the hospital of St. Thomas, Mont magny, where their - wounds - were dressed. Emile Robin's injuries, how ever, were so severe that amputation five unfortunate also of his injured Ms Was necessary, and he was vesterday brought to this city, in charge, of Dr. Richard and placed in the Hotel Dieu, where both his forearms were amputated. Notwithstanding his terrible injuries, Robin never lost consciousness, and endured the journey to Quebec with- out uttering a single complaint. He is a married man and the father of six childre DEPLORABLE DISTRESS In the Bitlis District Armenia. of Turkish Constantinople, May 1.--Earthquake and famine refugees report deplorable distress in the Bitlis district of él'urk ish Armenia. A despatch received, dat ed April 30th, says that arth shocks were still being felt there, ac companied by terrific thunderstorms and lightning which had wrought much havoc. The food supplies, it added, were inadequate. The authori ties are furnishing little relief except in rebuilding falling structires MINERS ARE RESCUED. Party Finds the Seven Men All in Good Shape. To the Stranded Steamers at Buffalo--John Donnelly's Suc cess-- Vessel Movements in the Harbor. Buffaio Courier. After two months of hard work during which several almost insur- mountable obstacles were encounter ed, Capt. John Donnelly, the well known Canadian wrecking master, has at last succeeded in dredging a chan- nel to the stranded steamers Hurl bert W. Smith and the William Not- singham, ashore at the foot of Michi- gan street. Capt. Donnelly has had two sand- suckers 'on the job continually and had expected to use the wrecker Saginaw, which he recently purchased from the Great Lakes Towing com- pany. The Saginaw has powerful machinery, but just at the time when she was most needed, she filled with water, and sank at her dock. She was raised and is again in commis- sion, but will not be used in the work. , He encountered another obstruction in his wrecking operations yesterday. During the big gale of January the heavy seas swept away a large por- tion of the concrete foundation of the breakwall. This concrete washed ashore and is now packed solid in the path of the wrecked steamers. It is said it will have to be blasted or dug out before the boats can be re- leased. Capt. Donnelly is well pleased with th: progress made in the operations and it is the opinion of vesselmen that he has dane'extremely well unden the circumstances, He oxpects to have tugs at work on the boats within the next few days. J, EY fis, an old-time newspaper publisher, justly complained of the increased postage on newspapers going to the Upited States from Canada. The new regulations would result in unneces- sary loss to the weekly papers of the dominion. A considerable portion of their issue was sent to the Amevican side to persons horn in Canada, and in this way kept in touch vear aftbr year with the land of their birth and old friends. The great good which re sulted, from continuing this connection hetweon Canada and Canadians in the United States was seen in the old cities and The annual subscription to a dollar a year, and with the new postal rates to be introduced they will have to pay fifty-two cents a year postage on each paper, which will dripple the Canadian publisher.
