When witness released his brake, he did not think that the speed of the train was increased. When he blew the first whistle, he was going about twenty miles an hour. Witness said that he had run between Kingston and Brockville for about twenty-five yeurs, and for the past six years constantly. For three or four years he had been on "No. 13," the local train which struck the rig. Witness could not see the rig, but could see the horses when they broke away. The rig was coming from the opposite side from him, ond he could not see it. John Wesley Lloyd, 13," was sworn. 'We were approach- ing Kingston at the usual rate of speed, about twenty-five miles an hour, when we struck the fog signals. I grabbed the bell cord, and the gineer applied the brakes; when came to the semaphore there was green light, for 'all right." The engineer blew the whistle at both crossings, and witness rang the bell. Witness supposed that they were going about twelve or fifteen miles an hour, when they struck some- thing, at the crossing. He thought the scraper had struck the crossing. After the crash, the engineer told him to get his torch, as they had struck something. The witness then told of the finding of the body. Witness had been fireman on the road for ten years. He said he started to ring the bell after the fog signals were reach ed, and kept on ringing it until after the accident occurred, He did not see anything when the crossing was reached. William Nicholson, station master, the outer junction, was asked by coroner regarding protection at He said that there was a flagman there from 7 a,m. to 6 p.m. A flagman had been there for about fifteen or sixteen years. There was no flagman there before that time that he knew of. He had been placed there, understood, because there had been some complaints, but this was before his term of office, and he knew nothing of it. There was no watchman at night, and was riven to understand, that it was not considered necessary, after the light had been placed there. The watchman was paid by the GTR. Never, to the knowledge of the witness, had there been a night watchman at this cross- ing. at the the crossing. he witness Other Witnesses. Thomas Francis, a farmer, was 'also ¢alled. He was at the scene of the accident. He noticed the train; which appeared to be going at 'the usual rate of speed. He did not hear the whistle, or the bell ringing. The first crossing was 'referred -to as a "blind" erossing, but witness said that this was not so. It was a public road. He knew this, as he was pathmaster for it. Robert Hewton Fair, farmer, called, gnid that he knew nothing about the accident, but was asked by Mr. Whit- ing, regarding the crossing, over which he has often driven. There were six tracks at the crossing. He was fa- miliar with the scene, and would say that the lights along the track were quite confusing. Witness had been travelling over the crossing one might when train "No. 13" was due, and had' found it very dangerous.' 1t was Impossible to hear the bells of an engine at this crossing. To Mr. Pope, witness said that he had. never asked, to have a night Watchman placed, at the crossing, and did not know of any 'other person who had asked that such steps be taken. "This concluded the evidence, the cor- oner stating that the evidence of Mrs. Spooner could not be taken, as she was still confined to the general pital.
