YEAR 78 -NO. 141 BL CONVICTION WAS QUASHED Duga Campbell Fad the Right to Sell Ice Cream on - Sunday. Judge Madden Finds That Mr. Campbell Keeps a Bona Fide Restaurant and That He Did: Not Violate * the Lord's Day Act. The police court con¥tion of Da- gald- Camppell, restauranteur and Turkish proprietor, Princess street, for selling ice cream on Sunday was quashed on Thursday afternoon by Judge Madden. Mr. Campbell had been found guilty of a violation of the lord's Day Aet in selling ice cream on Sunday, May 14th last. The police magistrate held that while the accused kept a restaurant, and supplied meals st all times, the front portion of his place of business was merely an jee cream parlor, and it was on this ground that the conviction was régis- tered, "Cf course Mr. Campbell appealed, thuough his counsel, D. A. Givens. He claimed that he had not violated the Sunday law, but was within his rights in selling ice cream with biscuits and sandwiches, In the contention he was susta'ned by Judge Madden, who held that he was conducting a bona fide ros taurant, and that thé front portion of his place of business was aged for serv ing regular meals, besides hight lun ches, ice cregm and soda water, © L. Whiting, K.C., actal for the evrawn and Mr. Givens for the appel lant. Further evidence was submitted, Mr. Campbell testifying that regular meals had been served at the tables in the [vont portion of his restavrant.
