ATTEMPTING TO - ENTER PRINCESS STREET STORE, OF But Young Man Was Allowed to Go on Suspended Sentence by Magis. trate--Claimed He Went Back of Store to Have Drink out of Bottle With Friend. J At police court, Thursday morning, Magistrate Farrell found a young man, aged twenty-two, guilty of hay- ing atiemptéd to enter the Abernethy | shoe store, Princess street, on the night of November 29th, and allowed the prisoner to go on suspended sen- tence. The young man's story was that he had béen at the back of the store, | with another voung fellow, having a { drink out of mn bottle, and that he bad po intention whatever of break- ing to the store. They went there for the purpose of drinking. The mag- .iistrate, however, did pot. put faith in | this story, as hé found out from the accused that he had been accustomed to going into barrooms for drinks, and he did not look upon the story as a likely one. The prisdner, it will be re membered, was arrested a week ago; and remanded, His arrest "Bert" Abernethy, was brought about by who was in the | tore at the time, and heard the noise at the back door. He was the first witness called in the cage, dnd he told his story to the magistrate. He had remained in the store from six until eight o'clock, in the evening, and had herd a noice at the rear of the store. At first he thovght that some of the drivers were at work, but on making ah investigation he found that' two young men were on the back steps. The shutters on the window bad been pushed open. Mr. Abernethy told about going the rear of the store by way of the {laneway, at the Randolph hotel, and taking the two fellows into custody. One fellow got away, 'but he 'managed tal keep hold of the other, took him intg the store, and then telephoned to thé police, Mell. Mowat appeared for the ae- 'oused, who pleaded "'not guilty," but odter the evidence had been concluded, the magistrate said that he had not the least doubt in his mind as to whe the accused had gone to the rear cf the store. He would find him guil- ty of the charge laid against him. The ascrused had been unable to give any good reason why he should go to the rear of the store, and this as =a strong - point towards. proving him guilty. to WILL GET SEVEN LASHES. He is Arthur Rood, a young farmer, and recently town- ship tax collector at North Bay, be having. been found guilty of a serious olience against a girl under fourteen vedrs of age, his wifé's sister. Rood feels his position very keenly, He was confident of escaping with a year or! so, awl was even sp confident that when he was arraigned for sem tence he smiled.
