HE MAKES AN ATTACK JOAN DOUGALL OF MONTREAL WITNESS, Asks if the Quebec Government Will he Represented When the Ne Temere Case is Argued Before Privy Council. Quebec, Feb. 26. Henri Bourassa declared himself in the legislature of Quebse definitely in favor of legislation to make mixed marriages legal, if there was now any doubt as to their being ON THE HENRI BOURASSA so. He denied in the strongest terms, however, the right of any government to interfere with the rights the Roman Catholic church at present has in the | province of Quebec to have its own people wartied according to its own forms at the risk of having their mar- ringes declared illegal if they departed Daily British Whig | M . Bourassa proceded to deal with te. possible effect that the 'ne temere" might have on Protestants ho were parties to mixed marriages with Homan Catholics. He declared that when the case was finally decid ed, if any doubt existed as to the va- lidity of such marriages, it was the {duty of 'the legislature to find some remedy for it. In fact, it would be the duty of the government to confer with the authorities of the Roman Catholic church, 80 as to remove the doubt, as had been done in Jiher countries. But as to the marriage of two. Ro- man Catholics, he declared, neither Bishop = Farthing nor Mr. Lancaster "should put their noses into the af fair." This he considered purely a matter to be dealt with by the Roman Catholic church itself, His speech was based on two ques- tions which he asked of Premier Gouin. They were ' (1) Was the gov- ernment consulted regarding the nature of the questions which have been drafted by .the Feder- al government to place before the Sa preme court? (2) Has the government of the province of Quebec been invited to be represented hy counsel when the case is argued? Sir Lomer Gouin answered briefly in the negative to both questions, but ex pressed the opinion that it would be as well for the government of the pro vice of Quebec not to ask for the right to be reprgsented by counsel when the matter cones before the supreme court, in view of( the fact that a case is now before the privy council to decide whe- ther the supreme court has the right to. give opinions on points affecting constitutional law as relating to the jurisdiction of the province. Ottawa, Feb. 26.--Tie provineés will be given an opportunity to assert their jurisdiction in regard to marriage when the stated case, founded upon the Lancaster bill, goes beforg the supreme court. It expected that Wallace Neshitt, K.C., as counsel for the do- minion government, will argue that it is within the power of parliament to enact the Lancaster bill and make it law, The provinces may send counsel to argue the other side of the quest ion.
