Both partes live boro toweship. T. J. Rigney appear- ad for Young, and D. A. Givens for Banks. The accused was allowed out on bail. Banks told his story. which was to the effect that on November 30th he drove to the home of J. Cumpsou, 4c- companied by James Smith. While at Mr. Cumpson's place, they' met Younz Banks and his friend were sitting in the buggy and engaged in conversation with young and Cump- son. Banks said that Young him with having * called "gump.' He denied .this charge, wheroupon Young swore at him. Banks then told him to keep away, as he did noWwant to have any trouble. "At this Young pulled off his coat and said he could "lick" me," said Banks. "I again told him to keep away. Young then caught me by ths «oat and told me that I would have to fight. He tried to pull me out of the rig, and I had to get out. He charged him and he got my anzer in his mouth. We were then separ- ated. and he made another attack on me. but Compson stopped him. 1 have not spoken to Young in years." Banks told the court that he had been treated by Dr. Freeman and ordered to the hospital. He spent eight days in the Hotel Dieu. Banks stated further that the sec- ond finger of his right hand was taken off two days after the injury occurred by Drs. Freeman and Svarks. He had not worked since he met with the injury, and was not able to. James Smith, who buggy with Banks, took place, was called and his evi- dence taken. It corroborated in every detail. the story told by Banks.
