Justice Britton has dismissed the action taken by Simmons Bros. against Charles HH. Powell and Thos. W. Sands, heard at a recent sitting of the Supreme Court in Kingston. The action was dismissed with costs and Mr. Powell was awarded $40 damages and Mr. Sands $30 dam- ages. In this case the plaintiff's claim was for an injunction order restrain- ing the defendants from excavating, building or using part of lot 297, Princess street, owned by Mr. Powell.
