Judge Lavell awarded the owger of the horse full damages of $175 and costs in the ace tion were assessed against the town- ships. Judge Lavell in giving judg- ment commented upon the penny- wise-and-pound-foolish policy of mu- nigipalities in not keeping their roads in proper repair, and further intimat- ed that it might bea proper case for preferring an indictment against both corporations for their persistent neglect to perform their duty with respect to roads. The judgment should have a salutory effect in these counties, A lot of money is gent on good roads and 'that ends the duty of the counties or townships, No pro- vision is made for the upkeep.
