There was no linen for the baby's bed. A bath robe was used, and the baby caught a cold. Witness had/ seen plaintiff drunk. He had told witness about having a wrist watch he intended giving to a woman he was going to marry after he got a divorce. Witness declared that Mrs. Ma- guire was possessed of a sweet char- acter. Plaintiff had told her that he went with other women. Evidence given by M. O. Breck, Norfolk, was read, and in this the witness declared that the plaintiff had liquor in his apartments and also had women visit him there. He told of all-night parties where whis- key flowed very freely. Mrs. Lily Davis, Norfolk, in her | evidence, said that she thought | plaintiff was very rough with his child. He would kick the child when there was no provocation whatever. He was also cruel to his wife. Mrs. Maguire was so different to her husband. Sle made no com- plaint and appeared to be afraid of him. She had very poor clothing and was poorly provided for. She ASPIRIN "Bayer" is only Genuine from September, 1914, till January, 1915. She declared that plaintiff "seemed to be rather crazy." When he was intoxicated, he would run around the house clad in his paja- mas. She had known him to be drunk for a week at a time. On one occasion when he was drunk, he got his shoes burned in the fire place. The day following this incident plain- tiff came home drunk carrying three new pairs of shoes. In four the plaintiff wag drunk the greater part of the time. Witness sald she often ncticed Mrs. Maguire crying and that her life appeared to be one of misery. Plaintiff always kept a revolver on a table near his bed, with bullets. His wife was always good to him. Witness told about Mrs. Maguire's mother providing clothing for the baby. Her mother also sent eggs to the house and other provisions as well. Her mother also provided her daughter with underclothing and boots. Plaintiff was kind to his child when eober, but rough when drink- ing. To the witness there did not appear to be any happiness in the home. Evidence of Meotherin-law, Mre. Carrie Martin, mother-in-law of the plaintiff, gave evidence. She said she had been a life-long resi- dent of Kingston. She told of plain- tiff having liquor the third night he was Lome from his honeymoon. He became intoxicated. Witness had provided clothing for the baby's coming and also money. Plainfift had asked 'her to do this, stating that his money wag in trust. When his wife was in a delicate condition, plaintiff would come home intoxicat- ed and &maeoy his wife by slamming the doors and making an unusual noise in the furnace room. Plaintiff had admitted to witness that he had struck his wife on one occasion, but expressed sorow for his conduct, and said that such a thing would hever occur again. He said he was going away and would try to be a better man. Plaintiff also told witness that he could not believe that his wife could do anythicg wrong. Witness did not see anything wrong in allow- ing her daughter to stay at the Ma- guire home on Union street. : Court adjourned at 6 pm. Wed- nesday till 10 o'clock Thursday morning.
