Cro- thers, Ltd., of Toronto, whom he had sued over a contract to haul machinery from the Arbade mine to Elk Lake, the action coming before Judge G. H. Haywara in Division Court sittings at New Liskeard on Tuesday morning. R. D. Cumming appeared for the plaintiff and costs of the case included counsel fee of $15. Defendants had paid $69.22 in- to court and previously had paid $180.00 on account, His Honor was told. An exhibit at the hear- ing was a series of five photo- graphs of the road from the Ar- bade mine to the floating bridge across the Montreal River be- yond Matachewan and, although Watson himself described the road as neither good nor bad, the pictures suggested that going over it must have been rough in places. Watson claimed Mr. Norrie of the Crothers Company had inter- viewed him in Matachewan on August 14 last and had struck a bargain then for plaintiff to haul the machinery, first to the float- ing bridge and then, after a por- tage, to Elk Lake. The distance from mine to bridge, Watson said was five or five and half miles, and the agreement for this phase of the work was two dollars daily for ten hours, and board. Plaintiff told Mr. Cumming that, for the 38 or 40 mile run from the floating bridge to Elk Lake the rate was to be $15a day at a dollar and a half an hour. This was necessary because his - truck, which goes ten miles ona gallon of gasoline, could not be handled* over that stretch for the same money. to plaintiff, had said he would make it all right, although no particular amount had been men- tioned. Some days there had been two trips between bridge and Elk Lake. : Corroboration of the conversa- tion between Norrie and Watson was given by Lucien Savoye, em- ployed by plaintiff. The claim was for $361.50, made-up of 25 days at $10 daily, 17 hours over- time at one dollar an hour, six days (to Elk Lake) at $15 daily, and three hours overtime at a dol- lar and a half an hour. Credits included 90 gallons of gasoline at 36 cents a gallon, a quart of oil at 30 cents, deduction for Nation- al Defence tax, five dollars, and paid on account $180, for a total of $217.75. ENLARGE PLANTS FOR REFINING COBALT; SHORTAGE IS FEARED Of interest to mining men of the district is arecent report from Niagara Falls, to the effect that cobalt has been placed under di- rect allocation system in the United States, that a shortage ot the metal is feared and that re- fining capacity is being increased 50 per cent. The plant in Niagara Falls is being enlarged, the re- port said, and the uncertainty of shipments from abroad had caus- ed fears of a shortage. Cobalt metal is used as an alloy for steel, largely in the production of high- speed cutting tools, while its chemical compounds are used as adryer for paint and as a binder for applying enamel to steel.
