Burns of Kirkland Lake said. that the court should take into consideration that ' Troscinski acted under duress. Judge Robinson said that under Section 17 of the Criminal Code, certain crimes could be excused, if the person doing them was being actually threatened at the time he. committed them, and providing there was no conspiracy. However, _ he: could: not accept this as an ex- cuse in this case. He suggested to Mr. Burns that for Troscinski's: own protection he-should also plead: guilty to a charge of manufactur- ing counterfeit money. This will not, however, affect the amount of penalty imposed by. the court; Judge.
