SHALL WE PAY Unpaid Contractor's Bill to be "Little Ballot" Issue At Spring Ballot WORK DONE IN 1900-01 McGarry Company Petitions Board The so-called "Little Ballot" will be ,n evidence at the regular Village election in Wilmette this spring as the result of action taken by the Vil- lage board Tuesday of this week in response to a petition submitted by John A. McGarry and comparrjrre^avenue, is convalescing at the.Evans questing an expression from the voters on the question of payment of $4,210.35 to the company from the general funds of the village. The figure represents an amount repre- sented to be due the company for side- walks laid in the village in 1900 and 1901. The board authorized preparation of ai\ ordinance to provide for sub- mission of the question to the voters by the "Little Ballot" method. Did Work In 1900 In a petition signed by John A. Mc- Garry and Harry Fowler, the latter a well known citizen of the village, it is pointed out that in 1900 and 1920 the John A. McGarry company enter- ed here into contracts with the vil- lage authorities of Wilmette, as pro- vided for by ordinances, for the con- struction of a system of sidewalks in the village. p These contracts, the petitioners re- presented, were entered into by the company and the work was "faith- fully performed, relying upon the in- tegrity and validity of said • ordi- nances", and with the satisfaction "that the Board let the contracts in entire good faith". Ordinances Held Void vSorric of the-owners of the property benefitted paid their assessment for their improvement but others con- tested the validity of the ordinances with the result that the ordinances were by. the courts held to be void and under the Jaw, as it existed at that time .the company___haiLjio^ re^ dress as the Village authorities had fright under the then existing law ^as they nowTiaveâ€"-to pass an ordi- nance ior the purpose of levying an assessment for work already done. Amended Law No Aid This law was amended in 1907, the petition states, so that, in the event an ordinance was held to-be void after the work had been completed, the village authorities had power to pass another ordinance to levy an assess- ment for the work completed and not paid for. The company hoped under this law to require payment from the owners of the property benefrtedj, but the courts have recently held amended [law not to be_retroactive, leaving the j company without remedy unless the [people of the village voluntarily [authorize payment. I?.,.*.?0"1 interest, amounting to $4,210.35 for sidewalks laid by them in the Village of Wilmette in 1900- 1801 under ordinances afterwards held to be void, for which work they have never been paid." In conclusion, the petition points out that while the improvement par- ticularly benefited the adjoining property owners, it was in fact a public improvement and a part of the sidewalk system of the entire village, and that "the citizens of the village do not want to continue to benefit at the expense of the company, but will willingly and gladly sanction the payment when the matter is brought to thir attention."
