Undoubtedly, if others who have expressed themselves unfavorably on the feasibility of the plan, had had the same facts as were given to the two legal forms quoted to the right, their opinion would probably have been the same as that of our attorneys. Deu- Sir: The Act providing for a Commission Form of Government provides for a Mayor and four Commissioners. The Mayor is to act as the Saiierinten- dent of the Department of Public Affairs and the Commissioners are to act as Superintendents of the departments of (1) Accounts and Finances, (2) Public Health and Safety, (3) Streets and Public Improvements, and (4) Public Property. Section 25 of the Act provides in part as follows: "The council shall have the power by ordinance, from time to time, to create. fill and discontinue otfiees and employment other than herein pre- scribed. according to their judgment of the needs of the city or village." The above quoted provision must be read in connection with'the gen- eral principle of law that discretionary duties given to Municipal otticers by statute cannot be delegated.
