Curran of the St Us2pd __Call Usih Q42 Th County Board Not Permitted to Split Precinets Until June Lake county voters will have to be satisfied with the existing 78 polling places for the primary election on April 12, 1938, according to an opinâ€" ion received from Attorney General Otto Kerner in connection with the proposed division of 28 precinets which had over 800 voters at the Noâ€" vember, 1936, election. Kerner‘s opinion states that not only is the board of stpervisors without power to act on its own voliâ€" tion at this time, but it is unlikely that a circuit court mandamus inâ€" structing the board to act would hold up. "It occurs to me that the county board of your county has no power of its motion at this time to reâ€" divide the election districts in the various towns in your county," the attorney general said. "If for any reason said county board shall fail in any year to reâ€" divide or readjust said election disâ€" tricts or election precinets, then said districts or precinets, as then existâ€" ing, shall continue until the next regular June meeting of said counâ€" ty board at which regular June meeting in the month of July said county board shall redivide or readâ€" just said election districts or preâ€" cinets in manner as herein reâ€" quired." Becaust of the wording of the statute on the proposition of splitâ€" ting up large precinets, it is quesâ€" tionable whether a writ of mandaâ€" mus directing the board of supervisâ€" ors to act would hold. The statute; in part, is as follows: _ Urged by an "interested group" represented by Attorneys J. A. Jadâ€" rich, E. R. Parnass and John Noll, the proposal of dividing the large precinets was put up to State‘s Atâ€" ttorney Charles E. Mason and the board of supervisors.
