Madrid.--The news that the direct male succession to the throne of spain had been assured by the birth Friday of a son to Queen Victoria sent a thrill of rejoicing throughout the country, and Friday night the happy event was celebrated from one end of the land.to the other. Queen Victoria and the child are both doing well. , The hurried departure of royai mes­ sengers from the palace at ten o'clock in the morning to summon the cour­ tiers and the members of the diplo­ matic corps gave the first indication that the birth was imminent. The usual gathering outside the palace courtyard was soon swelled by im­ mense throngs of the excited popu­ lace. The crowd waited in suspense until nearly one o'clock, when the thunder­ ing out of the first cannon shot signi­ fied that the ro^al accouchment was over. ! Soon after the royal salute the flags of Spain and Great Britain were raised over all the public buildings of Madrid. In the meanwhile the solemn cere­ mony of presentation was being car­ ried out Inside the palace. The mis­ tress of the robes, carrying a huge sil­ ver tray upon which was lying the newly born royal baby, accompanied by King Alfonso and Premier Maura, appeared in the ante-chamber where the courtiers had assembled. The young monarch appeared full of joy as the premier, raising the drapery which covered the infant on the tray, said: "Gentlemen, it is a prince." The solemn dignitaries thereupon forgot all etiquette and cheered both the klAg and the queen heartily. Haywood, first of the alleged participants in the avenging conspiracy by which it is averred the assassination of Frank Steunenberg was plotted and execut­ ed, was placed on trial for his life Thursday. Counsel for state and prisoner entered at once in a business­ like way upon the examination of prospective jurors, and kept steadily at the task for five hours. No juror was finally accepted, but substantia] progress was made and the indications at the close of the ses­ sion were that a jury would be ob­ tained by the end of next week. The William D. Haywood. opening day of the trial went through to its conclusion in quiet harmony, unmarked by unusual incident. It was earnest and business-like. Its striking feature was the entire absence of crowds or demonstration in any form. At no time was the court room more than half filled, and the streets form­ ing the courthouse square contained not a single loiterer. The case was halted shortly before five o'clock by the exhaustion of the jury panel, and adjournment was taken until Monday morning. Mean­ time the sheriff will summon a special venire of 100 men. The 11 men under examination, but not yet finally ac­ cepted or rejected, were locked up and will be closely guarded. PRI8CO POLICEMEN ACCUSED. According to a decree of the Span­ ish government, the son born to King Alfonso and Queen Victoria will bear the title of Prince of the Asturias. In many respects the As­ turias is regarded as the cradle of the Spanish monarchy, hence the pride taken in the title of the prince of the Asturias. San Francisco.--Twelve of the non­ union car operatives who were arrest­ ed Tuesday afternoon for shooting in the tragic Turk street battle were re­ leased Thursday morning on bail fur­ nished by the United railroads. According to these men, they were severely beaten by the police after they had been taken under arrest to the Central station. The assert that they were deprived of beds, food and water. Mayor Schmitz Thursday summon­ ed 50 leading citizens to advise him as to means of meeting the grave crisis Which the city is facing. No further fatalities are reported as the result of the riot on Tuesday. In­ cluding John Buchanan, who died Wednesday night, the death record has been limited so far to two, with three others of the wounded in a prfr carious condition. Strike breakers continue to arrive from the east and a number of addi­ tional cars carrying men for the com­ pany are reported on the way. A strike is threatened if the increase is not granted. The packers asked time to discuss the matter with the Chicago heads of the companies. Pittsburg, Pa.--Despondent because of ill health, Mrs. Carrie Slgsworth, 31 years old, killed her 18-months-old child and then shot and killed herself early Friday at her home in Allegheny. Washington. -- Attorney General Bonaparte has announced his in­ tention to prosecute the so-called har­ vester trust for alleged violation of the Sherman law, charging it to combination in restraint of trade. The value of the estate is estimated at not more than $25,000,000. The widow la left $3,000,000 in Heu of dower, all his nearest kin receive legacies and St. Luke's and the Orthopoedic hospitals of New York are given $100,000 each. His nephews, George Grant Mason and William Smith Mason, are the principal beneficiaries of the estate, receiving two-thirds and one-third, re­ spectively, of the residue. "Gentleman Burglar" Convicted. Chicago. -- Edwin Tate, known as "the gentleman burglar," and re­ cently notorious as escaping from the Peoria police after being charged with the blowing up of a safe to de'stroj evidence against Newton C. The loss is more than $100,000. DRUG TRUST IS ENJOINED DECREE ENTERED AT INDIANA** OLIS AGAINST COMBINE. Price Agreements and Blacklists, Threats and Other Means of En­ forcing Are Prohibited. Indianapolis, Ind. -- The so-called "drug trust" was perpetually enjoin, ed Thursday from continuing its operations by the entering of a decree in the United States circuit court for the district of Indiana on the com­ plaint of the United States govern­ ment. The defendants, 92 in number, who are members, officers, directors, agents and attorneys of the National Association of Retail Druggists, the National Wholesale Druggists' asso­ ciation, tripartite proprietors, "black­ list manufacturers," "direct contract proprietors," "wholesale contract pro­ prietors," and Charles C, Bombaugh, are perpetually enjoined from combin­ ing and conspiring to restrain trade in drugs, fix prices by agreement, blacklist retailers who cut prices, or to refuse to sell to any retailer on equal terms. All publication of blacklists is for­ bidden and all contracts and agree­ ments covered by the charges are de­ clared void. The direct contract se­ rial number plan is prohibited aB well as the securing of the adoption of schedules for the sale of drugs. The "direct contract proprietors" are enjoined from continuing the di­ rect contract serial plan and from co­ operating with any of the other de­ fendants in carrying out such a plan. They are enjpined from requiring any dealer from entering into a contract restraining trade in the articles of their manufacture and from placing serial numbers on the retail packages for the purpose of keeping records and tracing sales and from requiring the vendee to keep records of and report sale by serial numbers. All acts tending to restrict the free purchase of the articles or their manufacture are forbidden. The same prohibitions are ordered against the "wholesale contract pro­ prietors" and they are further en­ joined from securing the adoption of schedules for the sale of the articles of their manufacture and of other ar­ ticles in any market. The decree entered Thursday was dictated by the government attorneys and agreed to by the defendants. With the entering of the decree the litiga­ tion came to an end with a complete victory for the government. Gas Company Must Pay. Columbus, O. -- The city of Co­ lumbus won a signal victory in the supreme court of Ohio Tuesday in the case against the Columbus Gas company to enforce it pay to the city $4 ,000 annually for its franchise rights. The company paid the amount annually for several years then re­ fused on the ground that the city could not legally accept compensa­ tion. The city lost in the lower courts, and all these decisions are reversed by the Supreme court judges. The finding/affects many or the Utility companies, and the de­ cision 1b ot vital interest to them. COX COMES OUT FOR TAFT. Urges His Nomination as Part of Ohio Harmony Plan. Cincinnati.--Party harmony, victory in the municipal elections this fall and next year, W. H. Taft for president, J. R. Foraker for United States senator and A. L. Harris for governor, is the program advised by George B. Cox, former Republican leader in Hamilton county, In an interview Wednesday afternoon. When the attention of Senator For­ aker was called to the Statement, he said: "I don't want any political hon­ ors at the hands of the Republicans of Ohio except with their hearty endorse­ ment. Therefore, if what Mr. Cox suggests and recommends should meet with their approval, no one will support Secretary Taft more cordially than I shall." NO MEXICO-GUATEMALA WAR. Trouble Over the Lima Extradition Demand 8ettled. City of Mexico.---The Guatemalan affair has been settled. Mexico will not persist in her demand for the ex­ tradition of Gen. Jose Lima and Col. Onofro Bone, charged with complicity in the assassination of Gen. Barillas. Diplomatic relations will not be sev­ ered. Senor Gamboa, Mexico's minister to Guatemala, will be sent to Salvador. A Mexican consul will attend to this country's affairs in Guatemala. KILL8 SUSPECTED BANDIT. Butte Policeman 8hoots Man--Mob Seeks to Lynch Detective. Butte, Mon.--Patrolman Jackson Friday night shot and killed Harry Cole, as the latter was attempting to escape. Cole was arrested on sus­ picion of being one of the North Coast train robbers. A mob of 2,000 besieged the jail, led by Cole's brother, in an effort to lynch Detective Mc- Garvey, who they think, shot Cole. Helena, Mont.--The state of Mon­ tana Thursday offered a ,reward of $1,000 for the arrest and conviction of the men who, in attempting to rob the North Coast limited' passenger train at Welch's Spur Tuesday, killed engineer Clow. BAD WRECK ON INTERURBAN. Fire Victim's Body Found. Kansas City, Mo.--The body pf Miss Aurora Wittebort, the artist, who lost her life in the destruction by fire of the University building, waB recov­ ered from the ruins Friday. Golf Clubhouse Burned. Chicago.--TheHomewood golf club­ house at Flossmoor was destroyed by fire Friday. The clubhouse was built in 1900 at a cost ot $65,000 and the furnishings cost $35,000. Forty-Eight Lost in Poitou Wreck. Marseilles.--The latest report re­ ceived here concerning the Ipsa cr the French steamer Poitou, wrecked off San Jose Ignarlo, Uruguay, are to tho effect that 40 passengers and- eight members of the crew lost their lives. Edwardsville, 111.--While a south­ bound through electric car from Springfield, containing 20 passengers, was halted on a curve of the McKin- ley interurban line to repair a trolley Friday afternoon, within a few miles of here, an extra locomotive drawing a work train dashed around the curve coach, injuring nine persons, Beveral seriously. * V Train Goes Through Trestle. Flemingsburg, Ky. -- Two persons are dead, two others are fatally injured and ten are seriously in­ jured as the result of an engine and two coaches breaking through a double-decked trestle on the Cincin­ nati, Flemingsburg & Southeast rail­ way two mileB from here, falling 50 feet to the creek below. Prison Term for Hummel. New York.--One year in state pris­ on and to pay a fine of $500 was the sentence imposed Friday upon Abra­ ham Hummel, the lawyer who was convicted of conspiracy in the famous Dodge-Morse divorce case. Chicago.--A fatal train wreck, oc­ curred on the Chicago, Burlington & Quincy railroad in Chicago at ^the Hamlin avenue crossing Thursday. One Chicago woman was killed and more than 20 persons were Injured. Providence Machinists Strike. Providence, R. Their special train, running 50 miles an hour, struck a defective switch at Honda, a lonely station on the sand wastes of the Pacific beach, derailing the train, smashing the coaches into flinders, killing 31 almost instantly and injuring more than a score of o<Ji" era. The bodies of 21 lie in the morgues of Santa Barbara and ten more are at San Luis Obispo. The statement tl\jit the train was making terrific speed when it struck the defective track is borne out by the fact that it covered the 61 miles of curves and crooked track between here and Honda in exactly 100 min­ utes. There was no warning of the im­ pending calamity. The special plunged upon the defective switch, and in an Instant the big locomotive, baggageP car, diner and Pullman were hurled together in a huge heap of wreckage. The engine shot forward on the broken track, tearing up the rails and ties and twisting the iron spans into fish hooks. The baggage car half buried itself in the sand on the right side of the locomotive. The dining car in which were 32 persons eating their noonday meal, leaped into the air and. was thrown directly on top of the demolished locomotive. Nearly every person in this coach was instantly killed. Scores were scalded by steam escap­ ing from disconnected pipes in the kitchen of the dinar. The terror and turmoil of the scene was indescribable. Many of those who escaped instant death by the first im­ pact were crushed by the rear coaches hurled upon the wreckage. Others, pinioned in the debris, were roasted alive. The wreckage caught fire from the coals of the engine, but was ex­ tinguished in a few minutes by the passengers who eseaped injury. LOCKED UP IN H18 OWN JAIL. Jailer of Newport, Ky., Caught In Raid on Crap Game. V Cincinnati.--As a result ot anti- gambling agitation in Newport, Ky., a peculiar situation has developed in connection with numerous arrests. Saturday night Chief Lickert, assisted by nearly every member of the police, force, raided a crap game almost op­ posite police headquarters. The pro­ prietor and about 25 well known citi­ zens were caught, several of whom claimed to be only spectators, and every cell in the jail was crowded. It was long after midnight before the last of th$ prisoners succeeded in se­ curing bond and . was released. City Jailer Ben Ploeger was among those captured and he experienced the unusual sensation of being locked up in his own jail. It was found neces­ sary to release Ploeger on bond first so that he could in turn officially re­ lease the others as fast <us blind was offered. NINETY MINERS ARE KILLED. Fire in Mexican Mine Causes Terrible Loss of Life. Meexico City.--According to a dis­ patch which was received from the city of Torreon, Coahuila, at a late hour Sunday, 90 lives were lost in a fire which occurred in the Cornethas shaft of the Ternera, group of mines in the town of Velardena, state of Du- rango. The fire started Friday nijrht in an abandoned shaft. At the time tftertj were 107 men working in another part of the mine and but 17 of them es­ caped. Thirty-five bodies have been recovered. Murders Her Son-in-Law. Maysvtlle, Ala.--Angered because her son-in-law, Frank Albright, had come home drunk and driven the fam­ ily from home, Mrs. Mattie Connally murdered the man by .shooting him with a shot gun. Strikers Let Cars Alone. San Francisco.--Fifty street cars were operated Sunday over two of the 20 odd lines composing the United Railroads system. Most of the pas­ sengers were women. There was lit­ tle disorder. Salvation Army Celebrates.
