HALE The committee on Finance presented the following report, to-wit: February 18th, 1936. Mr. Chairman and Gentlemen of the Board of Supervisors: Your Committee on Finance to whom was referred the matter of the issuance of Tax Anticipation. Warrants, would beg leave to submit the following report on said matter: Your Committee met at the Court House In the City of 'Woodstock on Friday, February 7th, 1936, with the County Treasurer for the purpose of preparing a resolution for the issuing of additional Tax Anticipation Warrants on the County Tax Levy for the year 1935, and after due consideration and investigation your Committee feel that it is necessary to issue Tax Anticipation Warrants to defray the ordinary running expenses of the County and would recommend that the following be adopted, to-wit: ' Woodstock, Illinois ' ., ' February 18, 1936 WIIEREA8; there is not at thid time sufficient money in the Treasury of Mc- Henry County to meet and defray the ordinary expenses of the County, and it is necessary at this time to provide a fund to meet all such expenses by Issuing and disposing of anticipation warrants to be drawn against the County tax levied in the year of 1985 in the way and manner provided by the Statute of this State for the issuihg, ^iid disposing of warrants. BE IT RESOLVED by the BoatS of1 Supervisors of the County of McHepry that the County Treasurer of this Colihty be and he is hereby authorized and directed to issue and sell as needed, anticipation warrants to an amount not to exceed the sum of $40,000 against the County tax levied in the year 1935, but in no event shall the anticipation wardants issued, exceed 75 percent of the amounts of the appropriation tax levied for the year 1935; that said warrants shall be issued as needed in the sum of $5,000 each and each warrant to be so drawn so that the same shall draw interest at the lowest available rate not to exceed 6 percent per annum from the time of its issuance until paid or until notice is given that said warrant is recalled for payment, which anticipation warrants are issued for the purpose of creating a fund from which payment of the ordinary and necessary expenses of said County, mav be paid. BE IT FURTHER RESOLVED that such anticipation warrants shall, when drawn, show upon their face that they are payable solely out of the tax, when oollected, and not otherwise. Stevens that the report of the committee on Finance be approved and the resolution authorizing the issuance of Tax Anticipation Warrants be adopted by this Board, and the roll being called Suprs. Stockwell. Wright, Palmer, Beck, Clawson. Hughes, Hemmer, Stewart, T^Tison. Stevens. Mav. Freund, Hale, Filip, and Asst. Supr. McConnell voted aye. nay none. Motion declared unanimously carried. Supr. Hemmer moved that $7,800.00 be appropriated and transferred from the General County Fund to the Pauper Fund to pay the Poor Claims allowed at this meeting. Said motion was duly seconded by Supr- Wright and the roll being called was declared unanimously adopted. State's Atty. Lumley, being present at the meeting, was called upon by the chairman. Mr. Lumley addressed the Board and stated that in the past several months he and his assistants had had several meetings with the Treasurer's Committee and Mr. Peteit and his Counsel to try to arrive at some agreement pertaining to the shortages as shown in the audit of the former Treasurer's books, and that they now had tendered to him an offer of settlement as to the cash unaecouted for. Mr. Lumley then outlined in detail the shortages for the years. 1931, '32 and '33 and stated that the first offer of settlement was $1,973.47 but that they were now willing and ready to settle for $3- 054. 47. Mr. Lumley stated that he was ready and willing at any time to prosecute the five different suits started In fhe Circuit Court against Mr. Peteit and his bondsmen but he wanted the Board to know that It would be a long and costly proposition and it would be questionable that in the end that a conviction could be had. Supr. Wright stated that he was a member of the committee in charge of the investigation from the beginning, and at no time did Mr. Peteit deny any. of the allegations as contained in the auditors' report and that it was his opinion that if he owed any of it, he" owed it all. Supr. Beck stated that if the Board so desired he would endeavor to clarify the figures mentioned. Mr.„>Beck then outlined, in detail, as a member of the committee, how the several amounts were arrived at, and that if1 the Board did accept this proposition of settlement that they were being asked to condone something that would be quite hard for them, and if they did not accept it, there was a possible chance that in the end thev might get nothing. He ..further stated that there were additional items not mentionied In this settlement such as th£ ampunt of $1,600.00 spent by Mr. Peteit. over and above the amount allowed him by this Board. Supr. Stewart wondered if the liability of a bondsman was the same a* the liability, of ;i s.tocHholder of a bank. He was inform ed that they were not the same. Supr. Wright again stated that when anyone went, on a personal bond, they, were Just taking their own chances. Supr. Hemmer stated that the jury fees on five, different suits would amount to a great amount of money and in his opinion the bondsmen should not be prosecuted. State's Atty. Lumley stated that if they went to trial on these suits, he could lie made to prove that every bit of money that came into Mr. l'eteit's bands was actually received by him. Supr. Harrison stated thkt if the Board had to pay for surety bonds, it would cpst the County between $3,500 and $4,500 a year. Chairman Rosenthal stated that in his opinion when a public officer gives a bond, it is expected to be good. Supr. Palmer stated that he was a member of, this committee from the beginning and that he did not in any way enjoy it, but he felt that the committee had done its duty, and he did not like the idea of accepting this settlement but if the Board accepts or rejects, in either case they will be criticised and that he was sure that to prosecute the five suits would be an expensive proposition. Supr. Hughes stated that to get the matter ^before the Board he would move tluPt the proposition of settlement be accepted. Said motion was duly seconded by Supr. Harrison Several Supervisors stated ithat they were not in favor of voting the proposition at this time. It was fsupr. Stockwell's opinion that In the evept that the proposition was accepted or rejected, a report should be made through the press of the County to the Tax Payers. Supr. Hemmer concurred with Supr. Stockwell in his opinion and suggested that a majority and minority report be given if the proposition Is voted upon at this time. The State's Attorney was asked if it was necessary to pass upon the matter at this meeting. Mr. Lumley informed the Board thai there was no great hurry on. a matter of this kind. Supr. Hughes was then asked to withdraw his motion and after some discussion, the motion was withdrawn by Supr. Hughes and the second was withdrawn by Supr. Harrison. The Committee on Roads and Bridges made the following report which on motton of Supr. Palmer and duly seconded by Supr. The roads have been plowed out manv times only to drift full to the tops of the pile's, thrown out, each time becoming worse and worse, which together with the below zero temperature caused the snow to get so deep and hard that1 it is al#iiost Impossible for the county sncw plows to clear the highways, and attempts have been made to open tracks in the adjoining fields. Some farmers advise that 'the snow plows be kept in the sheds as they spoil their- sleigh tracks and others demanded that the roads be plowed out. We think that a few days of above free*|ng weather would soften the snow so that the plows could handle it, and that until such time satisfactory progress is impossible. The monthly reports of the County Clerk and Circuit Clerk were presented and read and orders placed on file. The clerk presented a notice with reenrd to the Keeshin Motor Express Co., Inc. which was referred to the State's Atty. for his investigation. * An acknowledgment from the family of the late Honorable Charles T. Allen expressing gratitude for sympathy shown, was presented and read and ordered placed on file. Several eommunicactions from the State of Illinois, Department of Public Works and Buildings were presented and read and ordered placed on file. Supr. -Hemmer stated that at the January meeting, the Board took no action upon the recommendation of the State's Attorney to discontinue the additional salary for his assistant and that he would move at this time that the additional salary be discontinued on and after January 1st. 1936 Said motion was duly seconded by Supr. Rt. 11, sec. 11 Engl labor The County System of roads was reported all open hs to snow Mar. 5, but at such inconvenience and loss to the traveling public, and great hardship,to the plow operators, and damage to the tractors and plows, that it will long be remembered. The accompanying photograph of the County's 60 horsepower caterpillar tractor plow In action shows plainer than words why the process of opening the roads was so slow and expensive. They were backing up and slanrming into the snow with the governor held wide open and making from 1 to 10 feet at a smash. The outfit wetghs 14 tons. The cat. 35 plow was coupled ut> wtth the cat. 20 tractor and they went up on top of the drifts and took the snow off In layers, which necessitated 5 or 6 trips on the worst places instead of one or two trips. The $6000 fund that the committee was reserving for new equipment is spent for snow removal, and it looks like the road work will have to be curtailed again the coming season, especially so if the County is to continue to buy right of way for State roads. Another meeting is called for tomorrow, Mar. 11. 1936, at Chicago, in the matter of proposed new rsilroad crossing Section 6 M F. T. the proposed concrete road south out of Crystal Lake, Illinois. _ We have received, from the M. F. T. funds for maintenance $149.29 for machinery rental and offered same transferred to the County highway fund. Your committee estimates that there will be necessary for the care of the McHenry County patrol system of roads, an appropriation from the County highway tax fund in the sum of $5000 until the next meeting of this Boa/fd.
