Just recently, I took a resolution on estate taxes to the National Governors conference on behalf of Governor Thomp son. In the version which passed, the governors said they "are deeply concerned about the accelerating loss of family farms caused by estate tax liabilities that are based on speculative value rather than upon the actual earning capacity of such land. Section 2032A wlflie Internal Revenue code provides that for estate tax purposes, real property used for farming shall be valued according to its actual use rather than its potential value for other uses. In recommending this provision, the House Ways and Means committee specifically states in its report (94-1380) that it would be unreasonable to require that the "speculative value" be included in an estate with respect to land devoted to farming or closely held business. The Internal Revenue Ser vice, however, is proposing regulations that would limit application of section 2032A to those cases where there is direct and immediate com petition for such other uses as residential, commercial, or industrial development. By refusing to recognize speculative pressures that have escalated farmland prices in areas not subject to develop ment for other uses, the proposed regulations would, in effect, bar the application of section 2032A to the majority of farm estates in this country. The National Governors' association urges the Internal Revenue Service to modify this proposed regulation to reflect congressional intent that section 2032A apply to farmland affected by speculative pressures as well as to land under pressure for immediate developmenF." I believe the governors are absolutely right. Taxation of agricultural land must be based on its value in production agriculture. To base taxes on speculation is to toy with the very basis of the greatest food producing machine in the history of mankind. Our nation and our world cannot afford that.
