Dec. 19 & 26,1979, & Jan.2,1980) Legal Notice ORDINANCE WHEREAS, the State of Illinois has enacted "An ACT regulating wages of laborers, mechanics and other workmen employed ift any public works by the State, county, city or any public body or any political subdivision or by any one under contract for public works," approved June 26, 1941, as amended, being Section 39s-l through 39S-12 Chapter 48, Illinois Revised Statutes, 1973, and WHEREAS, the aforesaid Act requires that McHenry Community Consolidated School District No. 15 of the City of McHenry, McHenry County, investigate and ascertain the prevailing rate of wages as defined in said Act for laborers, mechanics and other workmen in the locality of said City of McHenry, McHenry County employed in performing construction of public works for said McHenry Com munity Consolidated School District No. 15 exclusive of maintenance work. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF EDUCATION OF McHENRY COMMUNITY CONSOLIDATED SCHOOL DISTRICT NO. 15: SECTION 1: To the extent and,as required by AN ACT regulating wages of laborers, mechanics and other workmen employed in any public works by the State, county, city or any public body or any politicial subdivision or by any one under contract for public ' works, "ap proved June 26, 1941, as amended the general prevailing rate of wages in this locality for laborers, mechanics and other work men engaged in the con struction of public works coming under the jurisdiction of McHenry Community Consolidated School District No. 15 is hereby ascertained to be the same as the prevailing rate of wages for construction work in McHnry County area as determined by the Department of Labor of the State of Ilinois as of May 1979 a copy of that determination being attached hereto and incorporated herein by reference. The definition of any terms appearing in this Ordinance which are also used in the aforesaid Act shall be the same as in said Act SECTION 2: Nothing herein contained shall be construed to apply said general prevailing rate of wages as herein ascertained to any work or employment except public works con struction of , McHenry Community Consolidated School District No. 15 to the extent required by ,the aforesaid Act. SECTION 3. The McHenry Community Consolidated School District No. 15 Board 5 of Education secretary shall publicly post or keep available for inspection by any interested party in the main office of the McHenry Community Consolidated School District No. 15 this determination of such prevailing rate of wage. SECTION 4: The secretary of the Board of Education of McHenry Community Consolidated School District No. 15. shall mail a copy of this deter- mintion to any employer, and to any association of employers and to any person or association of employees who have filed, or file their names and addresses, requesting copies of any determination stating the particular rates ana the particular class of workmen whose wages will be affected by such rates. SECTION 5: The secretary of the Board of Education of McHenry Community Consolidated School District No. 15 shall promptly file a certified copy of this Ordinance with both the Secretary of State and the Department of Labor of the State of Illinois. SECTION 6: The secretary of. the Board of Education of McHenry Community Consolidated School District No. 15 shall cause to be published in a newspaper of general cir culation within the area a copy of this Ordinance, and such publication shall constitute notice that the determination is effective and that this is the deter mination of this oublic body. Dec. 19,1979) Legal Notice / ORDINANCE NO. 79-0-18 AN ORDINANCE AMENDING ORDINANCE NO. 79-0-17 KNOWN AS THE "MUNICIPAL UTILITY TAX" ORDINANCE WHEREAS, By ordinance previously enacted, the Board of Trustees of the Village of Lakemoor did establish and impose a tax upon certain utilities providing services in said Village; and WHEREAS, said or dinance provided that said tax should become effective on January l, 1980; and WHEREAS, the utilities affected by this tax have each indicated their inability to make necessary equipment and billing ad justments by said date, and have each requested an extension of the effective date of said ordinance; and WHEREAS, it is deemed to be reasonable and proper to grant said extension: NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LAKEMOOR, McHENRY COUNTY, ILLINOIS, AS FOLLOWS: ARTICLE I That "Section 5" of said ordinance No. 79-0-17 be, and the same lLereby__i8' amended to read as follows: Section 5. This or dinance shall take effect after publication and the tax provided for herein shall be based on the gross receipts, as herein defined, actually paid to the taxpayer for services billed on or after the first (1st) day of March, i960. ARTICLE II : That "Section 6" of said ordinance no. 790-17 be. and the same hereby is, deleted in its entirety and, in its place the following shall be substituted: Section 6. On or before the last day of June, 1980. each taxpayer shall make a return to the Village Treasurer for the months of March and April, 1960, stating: a. His name; . . b. His principal place of business - c. His gross receipts during those months upon the basis of which the tax is imposed; d. Amount of tax; e. Such other reasonable and related information as the corporate authorities may require. On or before the last day of every second month thereafter each taxpayer shall make a like return to the Village Treasurer for a corresponding two month period. The taxpayer making the return herein Srovided for shall, at the me of making such return, pay to the Village Treasurer the amount of tax herein imposed; provided that in con nection with any return the taxpayer may, if he so elects, report and pay an amount based upon his total billings of . business subject to the tax during the period for which the return is made (exclusive of any amounts previously billed) with prompt adjustments of later payments based upon any differences between such billings and the taxable gross receipts. ARTICLE III All ordinances and parts of ordinances in conflict herewith are hereby repealed.
