Albanese, accused in the arsenic- poisoning of his mother-in-law, resumes Wednesday morning in 19th Judicial Circuit court, in Lake county. The 45-year-old Spring Grove man, already sentenced to death for the murders of his 69-year-old father Michael J. Albanese, and his wife's grandmother, Mary Lambert, 89, is standing trial now for the murder of Marion Mueller, 69, of Fox Lake. The trial began last week with selection of a jury, which was com­ pleted Friday. Lake County Circuit Judge Lawrence Inglis ruled Monday there was a "substantial risk of prejudice" if he allowed the introduction of evidence used earlier this year to convict Albanese on the arsenic murder of his father and the at­ tempted murder of his 34-year-old brother, Michael Jay Albanese. According to the court's ruling, prosecutors may not tell jurors anything about claims by police that they found arsenic in the defendant's father's cookie jar and his brother's thermos bottle. Lake county deputy State's At­ torney Raymond McKoski said although he cannot use evidence concerning the death of the senior Albanese and the attempted murder, introduced in the previous trial, he will be allowed to present some of the same witnesses to testify about the poisonings of Mrs. Mueller and her mother, Mrs. Lambert. Judge Inglis ruled that evidence used to obtain the conviction on Mrs. Lambert's murder could be admitted into evidence. McKoski argued in Monday af­ ternoon's opening statement that only Albanese had the "motive and means" to kill his mother-in-law. The first trial was prosecuted by McHenry County State's Attorney Theodore Floro. Two trials were needed because Mrs. Lambert and the elder Albanese died in McHenry county, while Mrs. Mueller died in neighboring Lake county. Mrs. Lambert and Mrs. Mueller died within 12 days of each other in August 1960, while the elder Albanese died the next year. In Albanese's first trial, which was moved to Bloomington because of publicity, prosecutors said the murder of his father and attempted murder of his brother were part of a plan to take over the family business, Allied Die Casting, of McHenry, of which the senior Albanese was founder, the accused man president and his brother the treasurer. The poisonings of Mrs. Mueller and Mrs. Lambert were for a $67,000 inheritance, prosecutors charged. The marriage of Virginia and Charles Albanese was dissolved Thursday in McHenry county, with Mrs. Albanese being granted custody of their 9-year-old and 7-year-old daughters. According to the divorce agreement, money left from a promisory note in the sum of $150,000 from Allied Die Casting, will go into a living trust fund for the children, with Virginia Albanese as trustee. Tlie trust will get the balance after a court-ordered payment to the former wife of Albanese, a $15,000 fee to Richard Kelly for attorney's services in the first trial and a $40,000 fine from the circuit court. Name Bull Valley Resident "Outstanding Young Man" Thomas M. Przetacznik, who resides in Bull Valley area, has been selected for inclusion in the 1962 edition of Outstanding Young Men of America. Announcement has been made by the board of advisors for the Outstanding Young men of America Awards program. The program, which is endorsed by the United States Jaycees, recognizes the achievements and abilities of men between the ages of 21 and 36. These men are being honored for their outstanding civic and professional contribution to their commmunities, their states, and their nation. They were selected from nominations received from senators, congressmen, governors, mayors, state legislators, university and college presidents and deans as well as various civic groups, including the United States Jaycees. v. The program leaders believe that in every community there are young men working diligently to make their cities, as well as their country, better places in which to live. These men, having distinguished themselves in one or more fields of endeavor, are outstanding and deserve to be re­ cognized for their achievements. The criteria for selection include a man's voluntary service to community, professional leadership, academic achievement, business advancement, cultural accomplishments and civic and political participation. Lake Shore drive, Wonder Lake, escaped serious injury after the vehicle he was driving went off the roadway at the intersection of Hilltop and Nantucket, in Wonder Lake. Flanagan told county police the car brakes failed as he approached the intersection. The report, however, indicated that the skid marks showed all four tires were "locked up" and that the speed was greater than 35 mph. Flanagan was treated at the scene by the Wonder Lake Rescue squad. He was ticketed for failure to stop at a stop sign. A Wonder Lake man was cited for failure to yield the right-of-way following a two-car collision that < occurred at the intersection of Ringwood and Elm streets last Friday afternoon. Kevin G. Weisenberger, of 7717 Sunset, Wonder Lake, was ticketed after the vehicle he was driving struck another car. The driver of the other car, Daniel J. Lechowicz, of Route 2, Genoa City, Wis., told McHenry police he was driving north on Draper road when the Weisenberger auto made a left turn in front of his car. Weisenberger said he did not see the Lechowicz car because of a preceding northbound vehicle, which was also turning left. Two passengers, Kris I. Forster, of 3718 Lee street, McHenry, was taken to McHenry hospital by the McHenry Area Rescue squad following a two- car accident at the intersection of Kane and Green streets last Friday, morning. Ms. Forster was heading south on Green street when a car driven by Mark L. Higby, of 1310 Thornwood, McHenry, entered the intersection from Kane avenue. Higby was cited for failure to yield the right-of-way. Steve E. Roalsen, of 1205 Third street, McHenry, was ticketed for failure to yield the right-of-way after a collision at Elm and Third at about 1 p^m. last Friday. Roalsen told police he was on Third street at the intersection when the driver of a vehicle in the outside lane waved him on.
