Ebi Ehrlich Begins Action to Get Permit for Apartment House OFFICIALS SUMMONED Promises 'Fight to Finish' On Question Wilmette's zoning law will be sub- jected to the acid test in the courts as the result of a summons in man- damus issued July 1, by Samuel E. Erickson, clerk of the Superior court of Cook county, on the relation of Benjamin H. Ehrlich, owner of prop- erty at the northwest corner of Fourth street and Laurel avenue, and which seeks to compel the Village of Wil- mette to grant permission for the con- struction of an apartment building at that location. Summons were served this week upon the Village of Wilmette, a cor- poration of Wilmette; Edward Zipf, Paul A. Hoffman, John C. Baker, Clarence E. Drayer, John F. Wiedlin, Albert N. Page and Frederick Tilt as board of trustees of the Village of Wilmette; Charles C. Schultz, as superintendent of public works of the Village of Wilmette, and Walter Zibble, as fire marshal of the Village of Wilmette. Appearance in court in response to the summons was designated for Thursday, July 10. Test of Zoning Law This prospective court action is virtually the first step in what leaders in the village declare will be the real test of the validity and strength of the Wilmette zoning ordinance. . It marks the fi-~t legal action in the fight of thosc--aligned on either side of the "apartment building" contro- versy which has claimed the serious attention of Wilmette's citizenry and officials for many months and which played such an important role in the campaigning' that immediately pre- ceded the recent village election when the "Home and No Flats party" em- erged victorious. The battle in the courts, both Ehr- lich and the village authorities assert, will be fought to the limit so that, re- gardless of the verdict in the Superior court, the case will be carried on into the higher tribunals in a "fight to the finish" test. The attention of every property owner in Wilmette will be glued upon this battle as it progresses in the courts, for upon the ultimate verdict will hinge Wilmette's status as a community of homes. The days of discussion in mass meetings are but a memory; the time for the acid test is close at hand. Hess Loses Case In this connection it is interesting to note that the case of William E. Hess vs. the Village of Wilmette, concern- ing the matter of the division of a lot at Twelfth street and Forest ave- nue, which found a verdict favorable to Hess in the Circuit court some months ago, when carried to the Ap- pelate court brought a decision, last week, favorable to the village. $1,384 Pledged to Date in Near East Campaign Latest results of the Near Fast Re- lief drive in Winnetka show that $1,384 has been pledged to date. The workers are still out canvassing. Zone 3, with Mrs. Douglas Smith in H. A. Craig has reported $209 for zone 4; the business men's pledges have reached $184. Zone 2, with Dr. D. W. Poff in charge, has not been heard from at this writing. The drive will continue until all the names listed -have been canvassed by the workers, according to Dr. E. J. Fonda, chairman of the committee in charge of the drive. Citizens of Winnetka and Hubbard Woods who have not been reached by the drive solicitors are asked to send in their pledges. The business men who are calling on the merchants include R. C. Papa and P. A. Bradford for Hubbard Woods; P. D. Blake, George Park, E. J. Stults, A. Lee Adams, M. I. Adams, and Earl Weinstock for Winnetka. The commit- tee in charge of the drive is composed of Dr. E. J. Fonda, chairman, B. W. Blow, William T. Wersted and W. C. Abel.
