THE FAIR--STH FLOOR--STATE 2500. a ae WHEN A STOP SIGN IS NOT A STOP SIGN Kenilworth Arrest Discloses Ina- bility to Enforce Stop Rule Ordinance Spear Evans of 953 Windes street, Winnetka, drove through a "stop" sign on one of the streets of Kenil- worth Wednesday of last week and was promptly arrested, but when the case came to trial the following Sat- urday afternoon at 3 o'clock, Police Magistrate Frank Rothermel found him not guilty. Evans does not deny that he drove past the "stop" sign without stopping, in fact he admits he was driving at exactly eight miles per hour, but he contended, and the action of the court sustained him, that it was the village.of Kenilworth and not he, who was in the wrong. The population of Kenilworth is not nearly 7,500, which is the minimum population a village must have before it is enabled to designate through streets and legally fine people who fail to stop before driving across such streets. Mr. Evans is in the employ of Thomas J. Lynch, village forester of Winnetka and well known tree sur- geon on the north shore. He is a member of the Chicago Motor club, and Attorney Robertson, from that organization, came out to defend Ev- ans, the latter having insisted on 2 continuance of the case at the time of his arrest. Motorcycle Officer Faulstick, of the Kenilworth police department, made the arrest, and at the time presented Evans with a ticket, charging him with "failing to stop" at Melrose avenue, on which there is a stop sign. He was driving north on Abbottsford road. When the case was called for trial the charge of "reckless driving" had also been added to that of "failing to stop at a through street." The officer who made the arrest conducted his own case. He made a determined effort to obtain a verdict of guilty but there was no evidence of reckless driving, not even in the origi- nal arrest slip which he gave the de fendant, and when Attorney Robert son explained the legal status of the village in regard to its not being authorized by law to enforce the stop signs because of its lack of minimum number of population, and further- more, his assurance, that if the case was found against his client, it would be carried to higher tribunals, the "not guilty" verdict was rendered by Ma- gistrate Rothermel. Two "Stop" Streets Kenilworth has two designated through streets, one within a block of the other. One is Abbottsford road and the other Kenilworth avenue. The same law governing the streets of the village does not apply to streets entering Sheridan road, it is pointed out. Sheridan road is a state highway and the "stop" signs at streets enter ing that thoroghfare are enforceable. ing that thoroughfare are enforceable. The Village of Winnetka, which alse has a number of streets designated as "through" streets, has been consider- ing for some time its exact status in this matter. The Village council at a recent session referred it to the streets, drainage, and forestry committee for investigation and report. The last offi- cial census shows the population of Winnetka under the 7,500 minimum, while, as a matter of fact, it has grown so rapidly since the last census that it now has far more than the minimum number. The council is considering the matter of taking a special census, following which it would be enabled, according to law, to maintain the "stop" signs and enforce the regulation.
