The following Special Report of the Road and Bridge Committee was presented and read to the Board, towit: Mr. Chairman and Gentlemen of the Board of Supervisors, McHenry Cdunty, Illinois: Your Committee to whom was referred the matter of the construction of a new bridge at the Barnard's Mill Bridge over the Nippersink Creek In Section 6, Township 45 North, Range 8 East of the Third Principal Meridian, beg leave to submit the following report on the matters before them. That we met at the Court House at Woodstock, Illinois on the 8th day of July, 1950, to consider a recommendation of the State Bridge Engineer that a new three (3) span continuous beam bridge of 98 root span and a 2 foot width sidewalk on each side be built subject to the approval of the State Division of waterways. We discussed the matter and concluded that if the new bridge did not carry extreme high water there would be little damage as the road to the east of the bridge is paved and the grade need not be raised. We decided to accept the above recommendation and Instructed the County Superintendent of Highways to so notify the State Bridge Engineer. subject to the approval of this Board. In case the Division of Waterways does not grant the permit, we would then revert to the reiwlr of the existing structure as described In a former report. to this Board. Township and Range aforesaid thence in a southerly direction along said S. A. Rt. S to its intersection with S. A. Rt. 32 near the center of Section 28. Township and Range aforesaid, approximately one (1) mile northwest of the Village of Algonquin, a distance of approximately 19,800 (3,75 mi.) feet. and. Be It Further Resolved, that the improvement shall consist of a gravel or crushed stone surface. Type B Modified, width - 20 feet - with the necessary excavation, drainage structures. etc., and shall be designated as Sectioft 43, MKT and. • Be It Further Resolved, that the -improvement shall be constructed by the County through its officers, agents and employees by day labor: and, v Be It Further Resolved, that there is hereby appropriated the sum of Fifty-six thousand and ho-100 dol* lars. (56,000.00) from the County's allotment of Motor Fuel Tax Funds for the construction of this Improvefeet and. Be It Further Resolved," that the Clerk is hereby directed to transmit two (2) certified copies of this resolution to the Department of Public Works and Buildings, Division of Highways, thfough its District Engineer's office at Elgin, Illinois. It was thereupon regularly moved by Supr Wright and duly seconded by Supr. Mackeben that the Resolution be adopted*by this Board, and the roll being called the Chairman declared the motion unanimously carried. The following Right - of - Way Agreement Resolution was presented and read to the Board, to-wit: IfrMiuat This Agreement made this 10th day of July, A. D. 1950, by and between the County of McHenry, a Municipal Corporation, and Arthur F. States, Martin A. Heine and Alexander S. Reed. Witnesseth That: Whereas, the drainage of said pond would benefit Arthur F. States, a landowner on the south side thereof, and Martin A. Heins, a landowner on the north side thereof, and also the County Highway known as the Huntlev-Algonquin Road, and Whereas, it has been proposed to drain said pond to the Northeast to a slough on the land of Alexander S. Reed a distance of approximately 1700 feet through a tile the sixe of which is to be 8 inches in diameter. Now, Therefore. Be It Agreed by and between all the parties hereto in consideration of certain sums to be paid hereinafter set forth and in consideration of* the landownera herein signing the official right-ofway plats dedicating lands necessary, for a 70 foot width of right-of-way as shown on said plats and in consideration of amounts paid to said landowners as fence damage and land damage and in consideration of the mutual covenants and agreements herein set forth, the tuUd Arthur F. States and Martin K. Hein, the within named landowners, hereby agree to furnish all labor, tools, materials, incidentals, etc., to install said 8 inch tile hereinabove referred to said tile to be so installed In a good and workmanlike manner on or before the 25th day of July, A- D. 1950. and when said tile is so successfully installed to said outlet hereinafter described to the Northeast, the County of McHenry will pay a share of the cost of such installation in the following manner: To Alexander S. Reed for outlet damage, $172.28. To Aithur F. States and to Martin A. Heinz, jointly the sum ot' $600.00, -provided, however, that from said sum of $600.00 the said Arthur F. States and Martin A. Heins shall pay to Alexander S. Reed a sum In the amount of $172.37. a It Is Further Hereby Agreed that In the event that the said Arthur F. States and Martin A. Heinz shall install said 8 inch tile line in a satisfactory manner to sufficiently drain the pond, aforesaid, to an outlet in some other direction than that above described and said outlet drain is not installed to the Northeast as above described, then the said Alexander S. Reed shall not be entitled to the payments from either the Countv or Arthur F. States oi Martin A. Heinz for outlet damages as herein provided, and the County of McHenry shall be obligated only to pay the sum of $600.00 to the said Arthur F. States and Martin A. Heinz upon the completion of said outlet in a satisfactory manner. It Is Further Agreed that in the event the tile aforenald is Installed to the Northeast to the slough outlet on the land of the said Alexander S. Reed, said Alexander S. Reed shall receive and be paid by the County of McHenry the additional sum of $55.25 for right-of-way dedication. D. 1950 at 10:00 o'clock A. t. (D. S. T.). to-wlt: (Copy on file in Co. Clerk's office) The meeting was called to order by the Chairman, Thomas F. Nolan, and the Pledge of Allegiance to the Flag of the United States of America was given by the Clerk with all members of the Board and visitors participating, and the roll being called by the Clerk the following members responded to their names, to-wit: August Ruth. Carl E. Wittmus, Frank Beck. Elmer Coy, Raymond Slavin, Charles Dunning, Roscoe Glenn, Harley Mackeben, Thomas F. Nolan, Aimer Aavang, Stanley Cornue, Frank B. McConnell, Frank May, Math Schmitt, John Filip and Asst. Suprs. A. M. Maxwell, A. B. McConnell and Paul Rosenthal constituting a quorum present. The minutes of the Special July Meeting 1950 were read by the Clerk and upon motion duly made and carried were approved and ordered of record. A Plat of White Oaks Bay. Unit Number 8 of McHenry Township, together with Plats of Welches Subdivision. first addition of Nunda Township, and Lake in the Hills Subdivision, unit Noi C, in Algonquin Township, properly certified, showing approval of the County Superintendent of Highways and the Zoning and Building Code Enforcing Officer were presented to the Board for approval. It was thereupon regularly moved by Supr. Filip and duly seconded by Supr. Schmitt that the plats be approved and the Chairman declared the motion unanimously carried.
