Sept. 24, Oct. 1, 8, 1969) i i i i i i i i i i i i i iMiiHii i i i i i i i • J IN THE CIRCUIT COURT OF THE 19TH JUDICIAL CIRCUIT, MC-41 ORDINANCE RESTRICTING THE POSTING OF NOTICES PLACARDS, BILLS AND POSTERS WHEREAS, it is deemed nec­ essary to protect the people of the City of McHenry against the nuisance of and incident to the promiscuous posting of certain places and structures, which result in a health and safety menace and in unnecessary ex­ pense due to the littering of streets and other public places; NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of McHenry that the Municipal Code of the City of McHenry, Illinois, be, and hereby is, amended by adding thereto the following article of Chapter 8: Section 59. No person shall post, stick, stamp, paint, nail or otherwise fix, or cause the same to be done by any person, any notice, placard, bill, card, poster, advertisement, or any oth­ er paper or device calcu­ lated to attract the atten­ tion of the public, to or upon any sidewalk, cross­ walk, curb or curbstone, flagstone, or any other por­ tion or part of any public way or public place, or any WED. SEPT. 24, 1969 - PLAINDEALER- PG. 9 lamp post, electric light, telegraph or telephone line pole, or any railroad struc­ ture, hydrant, shade tree or tree box, or upon the piers, columns, trusses, girders, railings, gates or other parts of any public bridge or viaduct, or other public structures or building ex­ cept as may be authorized or required by the laws of the United States, the State of Illinois, and the Ordin­ ances of the City of Mc­ Henry. Section 60. Any person, firm or corporation ad­ judged guilty of violating the provisions of this Or­ dinance shall be fined not less than Ten ($10.00) Dol­ lars nor more than Two Hundred ($200.00) Dollars for each offense, and each day that this offense con­ tinues shall constitute a separate offense here­ under. Section 61. If any clause, sentence, paragraph or part of this Ordinance is declared void by a court of competent jurisdiction, such decision shall not af­ fect the validity of the Or­ dinance as a whole, or any part thereof, other than the part so declared to be invalid. Section 62. This ordinance shall be identified as "Or­ dinance No. MC-41". Section 63. This Ordinance shall bp in full force and ef­ fect from and after its a- doption and approval by the City Council of the City of McHenry, and after the passage of ten days time from and after publication, as is by statute required.
