BUMDIRG EATEHMLS The execution of Tomps‘ett and Low- dcr at Pictou on the “Hit inst. for tnur- der, has ctlled forth several letters and two or three editorials iu the city pa- pers. As the condemned men were con- ï¬tted on purely circumstantial eviâ€" dence and strongly protested tlteir inno- eenre, great ell'urts were made to pro- cure a commutation of their Slliltcllcu‘. and the disregard of the petitions to that effect has been evnsured by many but defended by the Press. Judge Jel- let, ot' Bellevitle. has: given his opinion on the subj vet very freely and forcibly. strongly denouncing the matvkisb senti- mentality of those who interfered in behalf ofthe prisoners. and approving at" their execution ; adding that if men accused nl murder are to escape punish- ment simply because they declare them- selves innocentr they might as well be acquitted on their own ' evidence when they plead not. guilty in the dock. 'l‘ht-re are no doubt many worthy and intelligent persons who are oppressed by the conviction that 'l‘mnpsett and lintrdt 1' have suffered death for a critne they did not commit. and such persons will no doubt earnestly quote the die- tunt that "it is never sale to convict on circumstantial evidence ; †but they ought to reflect that unless a murderer is actually caught in the act, which is rarely the case, the prosecution has noâ€" thing to depend on but circumstantial evidence. and if that were disallowed nineteen out of twenty murderers-per- haps we might say ninety-nine out of every hundredâ€"would escape richly deserved punishment. Tompsett and Lender may have been innocent, but they new convicted on evidence quite as strong as has sent many other men to the t:allo\\‘.<â€"â€"â€"nmn, too. who Confes~cd : their guilt when they saw that nothing Cuuld begained by longer denying it. The l’ictou criminals of course knew that petitions on their behalf were sien- ed and presented, and there is a bare possibilityâ€"perhaps as strong.r a one as of their innocenceâ€"that they thought if they persisted in their asseveratiens they would be reprieved at the last tno- Incnt. At any rate they had a fair and impartial trial, and so strong a chain of circumstances tended to prove them guilty that thejury brought. in a ver- dict to that elfn-et and the judge ap proved it. The natural repugnunce to the idea ol'a man being unjustly execu- ted has given rise to the saying: that "It is better that a dozen murderers should escape than that one innocent man should be hanged ;†but the truth of this will not be very readily adtnit- ted by the hard headedâ€"we will not call them hard Itawfulâ€"thinkers who consider that the interests of society should be paramount to those of the in- . dividual. ’fhe apothcgtn is greatlyquo- ted by the opponents of capital punishâ€" ntcnt, who, however. will perhaps not be so ready to argue that it is better i that a dozen routes should escape than that one honest man should be punish- ed ; but it is jttst as true in the one case as the other. and. therefore, if ghanging were abolished tomorrow. it Would obviously be wrong to send a man convicted of murder to penal arr- \itnde tor life on evidence which it is now thnu.:bt ought not to consign him to the gallows.
