His honor Judge Dean gave judgment on Saturday last dismissmg the appeal and con. ï¬rming Jhe conviction of E. W. Myers by. Police Magistrate McIntyre for breach of the early closing bylaw. His honor ruled against all the objections taken to the by-law, holding that it was proper in form, and that the fact that it was not passed within the month men- tioned in the statute did not aï¬ect it; and also ‘ held that a sale by auction within the prohibit- ed hours was a violation of the by-law. The question of costs was reserved, his honOr doubting whether he should allow cests, as the fact that the by-law had not been passed with- in the month rather invited the attack, espe- cially as it was a case in which costs could not be given against the town.
