Farncomb, on Thursday, May 5th John Fell, M.P. 1’. for East Victoria, to Mrs. Rebeccu Charluttc Moore, both of the township of Smner~ ville. addition the mortgages still outstanding were transferred to Mr. Mullet. This settlement was made in good faith on both sides. but Mr. Mullet, in collecting his mortgages, found that some of them were bad investments. He then tiled a. new claim with the master, asking: him to open up the settlement with the executors, and claiming the right to rank upon the. estate for the full amount owing him cal- culating simple interest and giving,r no credit for the mortgages, and besides to make what he could out of his mortgages. As soon as it became known to the execu- tors that some of the mortgages were almost worthless. a fact which they had not known at the time of the settlement, the executors at once conceded that Mr. Mullet was not to be bound by his set- tlement with them, but contended that in taking the account the real value of the mortgages must be deducted. The master ruled in favour of the executors’ conten- tion, but held also that Mullet was not bound by the settlement made with the deceased in 1887, because he was an old man acting without the advice of a solici- tor other than Mr. Hudspeth himself. The master held that Mullet was then entitled to his money with compound in~ terest and now directs that the account be taken from the beginning with compound interest and that Mullet be charged with the real value of the mortgages. The claimant never contended for compound interest until his appearance before the master last week. Question of costs re- served. ‘T. Stewart for the executors.
