Fee vs, McAlpine.â€"This action was brought to recover the amount of a due bill made by the defendant, and excited a great deal of interest. It was tried without a jury. The due bill as it is at present is dated July 27, 1875. The defendant con- tended that it was made and dated July 17. and that the date was altered by writing the 2 over the 1. This figure 2 differs verv much from the other figures on the due bill. The plaintiff had been examined before Judge Dean and then swore this transaction took place on a circus day in Lindsay, and gave several instances which enabled him to fix that fact on his mind. and that the circus day was on the 27th Jrly ; that he saw a Circus hill ashort time before with that date on it ; and that theslue bill was in the same condition now as when the defendant wrote it and gave it to him. On the trial it was proven clearly that the circus tfluk place in Lindsay on the 17th. The defendant now swore that this transaction did not take place on a circus dav. He admitted having sold greenbacks to the defendant on that day amounting to $344. and having recover- ed the amount by cheque. He was subject- ed to a most rigid cross examination, in the course of which he was made to contradict himself many times. His books were ro- duCed and showed an entry on July lOt of business done on the 17th, but contained no entry of any dea iuqs with the defendant on the 27th. The defendant admitted havirg given the due bill on the 17th for $344, and produced a check for that amount, made on the 19th which check Mr. Foe had present. ed to the bank and got cashed as was shown liy his hank-book. The defendant said that plaintiff came to him on the 19th a short time before the bank closed and asked for l the money promising to hint: up the due 1 bill next day, but that he had never brought it up although he got the money for it. He also swore positively that the transac- tion took place on the circus day. which was the 17th ; that he had written the due bill and that the date had been changed. Mr. B I} Osler. the counsel for the plaintiff, made a very powerful address to the court in favor of his client. urging, that if the ver. diet was given against him It would be equivalent to finding him guilty of perjury and forgery. and that the evidence was not strong enough for that. In giving judgment "is Lordship regretted that the case had not been left to the jnrv, but said that he was not one to shirk his duty because it was unpleasant.
