Thereupon the council brought this action to have the by-law and deeds set aside, on the ground that they ‘were not passed in the public inter- est, but in the interest of Messrs. Fox and Reid, and were otherwise technically defective. During the progress of the case the chancellor expressed the opinion that Messrs. Fox and Reid were not entitled to more than the one hundred dollars pal-d by them to the council, and which the council offered to refund, but that while the council from time to time were different still the cor- poratlon was the same, and as the plaintifl's had caused the difï¬culty by passing the by-law they should pay the costs, and judgment was given declaring the by-law invalid and set- ting aside the deeds to Fox and Reid and arbitration proceedings, the township to repay them' the $100 and costs. \ G.
