' had been subpoenaed; THE PROCEEDINGS OUTLINED The. following is an outline of the proceedings: .At the outset it was found that the copy of the charges supplied to Mr. O'Leary. diaered from the orginal. It had one chug 5omitted. and some minor diflem ‘in‘ phraseology in other places. Then iMr. O’Leary addressed the judge, and declared that he. had asked the town solicitor for particulars of the broad,- vague chargesg contained in the resolution of council, but had not been able to get them. He and his client were thus placed at a. dis- advantage; they did not. know whati they were to be confronted by. It seemed as though council were out so he was to make his charge now, or hold his tangle hereafter. No- body hadanythingtosay, andthe judge congratulated Mr. Chalmers on his work at the hospital, and hoped that the town would always have as efficient; a. commissioner. The proâ€" ceedings lasted about an hour, and it is said that 25 or 30 witnesses vised. them to abandon the en'se {which they agreed to do. The judge. said that .Mr. Chalmers should have resigned before arrang- ing to go-inta partnership with Mr. Coomds ; but, that .in regard to the cement he was entirely blameless. When- the council gave up the cane, His Honor asked it there was any- body in the court-room who knew anything against Mr. Chalmers; il: l It was upon hearing these exphmaa- tqry statements that Town.Solicitor Hopkins took‘ council aside and ad- y. The third statement fainted to the :clialge of using tovmmterial to: outside work, The fact was tint two barrels of canent hpd :been ordered from the Rathbun. Company by Mr. Chalmers for the hospital and paid for by him on the'hospital account. By an error the book- keeper had charged these two barrels to the town as well; and hence, eouncil were led to believe that the commissioner had used town cement up at the hospital. F The second statement by" Mr. O'Leary answered , the charge that Mr. Chalmers had done work on out- side jobs. He had by permission of council overseen same work at the hospital, and' while" there had kept an eye on- fir. Bogue' 8 men in the absence of that contractor for three orfourdays. » ._ ‘ The first of these statements m with regard to the chumdthe commissioner's being. improperly in- bterested in the town contracts. The fact was that he had arrayed to re- sign from the service 0! the town to go into partnership with Mr. (30me He had taken his resignation to the meeting of council at which the charges against him were made and had not presented it, only because the charges were made.
