They were plainly directed by Judge Falconbridge that the intent with which the declarations were taken were not for them to consider; yet they, in the most barefaeed manner, dis- obeyed his instructions. One of the accused, to place a name on the voter’s list, boldly declared to his own personal knowledge by declaration, (equivalent to an oath), that the person so named was twenty-one years of age. The mother of the young man, and the young man him- self, told the grand jury under oath that he was not twenty-one years of age; yet the grand jury threw out the bill. This , is a sample case. But that there waa a preconcerted determination on the part of the grand jury to make short work of the perjury cases is indicated by a statement of the foreman, who before one of the cases was submitted made the remark that “they would make short work of them," and they did. But it rests with every member of the grand jury now to reconcile their proceedings with the oath they took. If more was wanted it is to be found in the refusal of the foreman to deliver up the remaining indictments when the crown counsel intimated their intention of with- drawing them. In open court, however, Judge Falconhridge taught the foreman what his duty was, and it is to be hoped that never again shall be exhibited by a grand jury in the county of Victoria such a shameful disregard of sworn duty. If what came through the door of the grand jury room be true, then a motion was 1 moved and seconded, before switness was examined, to throw out the false declara- tion cases. This motion, it is said, was put and would have carried but for the responsive shock of conscience it caused toothersofthegrand jury.
