COUNCIL-- A Regular Mgeting of the Township of Whitby was- held :in the Council Chambers, Brook- lin on Monday, March 9th, 1964 'at 7.60 p.m. with Reeve J. Good- win, Deputy Reeve J. Dryden and Councillors F. Sturch, J, Batty and D. Roberts present. Deputations & Interviews-- Mr. T. K. Creighton, Q.C. was present to explain to the Coun- cil a request from Mr. R. Dale representing Cambridge Lease- holds and their problems with : regard to a contemplated mort, [fuse on the property in rela- onship to the Site Plan Agree- ment of June, 1962 between Humberforth Investments and the Township. The presence of the Agreement on the Title of the Plaza is suffiicent to dis- courage those lending money on a $1, 140.000. Mortgage on the A new 'agreement was prepared by Mr. Creighton to preserve the rights of the Township as contained in the original agreement and at the some time to allow the mort gage to take precedence on title. This was verbally approved by Mr. Dale and upon the assur- ance by Mr, Creighton that the rights of the Township will not be materially affected the sign- ing of the agreement was auth- orized by Resolution #1. Mr. Creighton was queried on the present status of the matter of Mr. Eyers and the keeping of pigs contrary to By-law 1784, Mr. Creighton advised the Coun- cil that he was not handling this particular matter person- ally but would make an inquiry into the matter and report to Council. Mr. John H. Stroud, Treasur- er of the Twp .of Whitby School Area No. 1 Public Library Bd. presented copies to Council of the 1964 Budget, a financial statement for 1963, a librarai- an's report for 1963 and a copy of a letter from the Department of Education. Mr. Stroud also drew to the attention of the Council the following: "That there is.not at the pre- sent time any one capable of carrying on should our present Librarian become incapacitated. It is of paramount importance that this condition be rectified without further delay. A rate of 2.9 mills on the present assessment will provide only sufficient monies to carry on in a similar manner to pre- vious years. It will require a rate of 3.3 mills to implement our plans of obtaining an as- sistant capable of being trained to become the future Librarian. In support of the above, we attach a copy of a letter re- ceived from the Department of Education, wherein our Library was singled out as the best of its kind in Ontario, serving a population of similar propor- tion. Please assist us in maintain- ing it as such by providing the funds necessary to fulfill our programme of normal progress. To deny this Board's request for a rate of 3.3 mills will prevent the Library from continuing its healthy growth. Reeve Goodwin asked Mr. Stroud if he was informed as to the possible results to this lib- rary for next year if the Min- ister of Education proceeds to dissolve the local school sections and create .one school area for the whole Twp. Mr. Stroud in- formed the Council that he had discussed the matter with the Clerk but the effects of such legislation would have to be in- vestigated and a ruling obtain- ed-when the legislation has ac- tually been passed. Mr. Malcolm Porter was pre- sent regarding the Wm. Winter property in Lot 85, Concession 1 and asked for a ruling as to whether or not the parking of his trucks at his residence in an' Agricultural Zone would be an allowable use under By-law 1784. After some considerable discussion it was agreed that Mr. Porter should obtain a legal opinion in this regard.
